In an October 29th speech to a small gathering, Publius Huldah discussed her perceptions of the dangers posed by an Article V Convention of the States to propose Constitutional amendments. After viewing the entire talk, I understand why the leading figures of the Convention of States movement (COS) havent responded in depth to her various accusations. Her conclusions are often at the fringes of reason and she carries a deep and personal animosity to the leaders of the COS. Since the COS leadership choose not to address most of her accusations, please allow me, your humble blogger, to take up the mission.
On the bright side, I am better acquainted with the usual talking points of COS opponents which Ive read in endless repetition at conservative websites. If her arguments are swallowed whole, without knowledge of certain points in our history and tradition, the hostility of her adherents is perfectly logical. Publius Huldahs impact is significant for those who rely on her views and nothing else. Do not underestimate her influence. Ms. Huldah admonishes her followers to:
View COS supporters as conspiratorial enemies.
Just obey the Constitution as written.
Restore morality.
Support state nullification of federal laws, regulations, and scotus decisions.
Mix her talking points, let them ferment, and Ms. Huldah presents a powerful and heady brew against an Article V convention of the states. The foundation of her argument is a conspiracy in which nefarious groups, foreign and domestic, work toward our demise. The means to their ends is the Article V state amendments convention. Since COS supports an Article V convention, its leaders must be part of the scheme, and the many thousands of COS volunteers are simply ignorant dupes.

Article V ping!
Democrats steal votes. Steal Elections. You give them the ability to change the constitution en masse and you will get a Marxist America, not only in practice (as they do now at every turn) but also by the law of the land. They want a living constitution. They’ll rig it.
What the constitution needs, is to be obeyed. With justices who don’t do end runs around it. We need 9 Scalias, who follow the constitution, not 9 Ginsbergs who would ignore the whole document to get Marxist America
Leave the constitution alone...... remove those usurpers who would ignore and destroy it.
Like the enforcement of speeding laws, the supreme law of the land needs institutions inclined to follow and enforce the Constitution. The Framers provided such an institution in a Senate of the States. To this end, the 17A must go, and an Article V COS is the only means we have.
As for the judiciary, restore state appointed senators and wave goodbye to federal judges hostile to the 9th and 10th Amendments. The EPA's tyrannical overreach will also come to a screeching halt.
There isn't a right or privilege that can't be abused. We don't consider repeal of freedom of speech and press because some people engage in slander and libel.
No people ever met in convention to sell society into slavery.
> “Unless we reform our ruling institutions, the next eight years of Donald Trump will be just a bump in the road to grinding statism.”
Very true.
But consider that if Hillary Clinton had been elected, the Republic and its Constitution would have been finished. Article V would have been deemed a domestic terrorist banner and anyone engaged in a COS movement an enemy of the state.
Donald Trump has called for a new constitutional amendment for term limits. It is with high probability that such an amendment will never be accomplished by the US Congress because it goes against their own self-interest. It can only be done via an Article V states process.
The new President should call for supporting an Article V states process. Watch as Congress steps in to say it won’t be necessary, they’ll get on it. Then watch them slow walk such an amendment to a death and burial as the 2018 midterms loom.
The public still requires education on this part of the Constitution. Education requires marketing and promotion expense. Therein lies the immediate problem.
Levin is for all practical purposes, out.
You’re wrong on that.
The 2016 election showed the democrats are not able to steal votes from rural America which is where the states rule and where 38 states would be required o ratify any amendment to the Constitution.
The democrats would need to control 13 states in order to STOP any proposed amendment to the Constitution and they would have a hard time doing that, especially now.
For sure the democrats will never control 38 states to ratify, any more than they are able now to control 2/3’s of Congress to propose such amendments.
the real vote , you may someday find , was a landslide victory for Trump. These people are insidious. Don’t be naive. They didn’t steal enough.
The problem is not a runaway convention, the problem is getting any amendment through. All this blather we hear from people who tell us that there might be a runaway convention is political absurdity. The arithmetic simply denies it.
Even more absurd is the blather we hear that what is needed is more of the same. Get the right justices, they say. The right congressman, they say. Get the right senators, they say.
How has that worked out for us over the last century since the progressive era? You now have a Constitution that is virtually unrecognizable from the document that was written by the framers and amended by the Bill of Rights, a document that is unrecognizable from the post-Civil War era and the abolishment of slavery an and the ratification of the 14th amendment, a document that is even unrecognizable since after the New Deal.
If The Affordable Care Act and its history of misbegotten birth in the Congress and the jujitsu in the Supreme Court has not finely made plain to those who think that doing more of the same will get different results, one can only include that these people are simply resolute to learn nothing from history.
<>The new President should call for supporting an Article V states process.<>
Agree, and he might do so sooner rather than later if Mitch McConnell stands in Trump’s way.
There are two issues which are related, but not the same.
First: If there are 38 states which would ratify Amendments (or a new Constitution) which would alter our fundamental freedoms, we’re at war already.
Second, it’s correct that steps have to be taken to restore the relationship among the three branches to what was intended when they were created, which in our time means breaking the power of the Supreme Court. I don’t know that the amendment process (Article V or otherwise) is the best way to do this.
You have no idea who you are posting this to.
I guarantee you I am much more up to speed on election fraud than you could ever imagine.
Go away now. You have nothing to contribute here.
Excellent point. Indeed, it is far easier to block an amendment because it takes only 13 state chambers inside 13 state legislatures.
After this last election, the republicans control a supermajority of state legislative chambers. But not all of the state legislators in those chambers are educated on the process of Article V.
Rest assured that many fine state legislators are in fact well-versed on Article V and they engage in state cross-talk on the subject in various state supra organizations such as ALEC.

I think this falls short. "Steps have to be taken to restore the relationship among the three branches" and the several states. Let the states counter the Supreme Court's opinion of what is federal and what is state jurisdiction.

You were on the right track until the final sentence. The federal government in its present mode of operation and ethical state will never willingly give up power of any kind. The only means to reform our federal system is by means of an Article V Constitutional process by the states.
The states were the first to form the federal system and the first to place limits on it.
Unfortunately, since the 17 Amendment, the concentration of power in Washington DC has grown to the point that a limit on federal power is not even on the table for discussion.
I will share a little later a few illustrations how the federal power concentration can be reformed to a healthy ratio with the individual states.
But first ponder the consequences of a successful Article V states amendment process to fulfill the new President’s call for term limits in Washington. Ask yourself do you expect a movement by the states to stop at the water’s edge of term limits only?
They had something on Roberts. Either a gay thing or illegal adoption. He was t vetted properly.
The criminal element that is the dhimmicrat party needs to be destroyed somehow before honest government can be restored.
Very interesting, important discussion. (Never heard of Publics Huldah) Have any of the article V States put forth a list of grievances? Thanks for your work Jacquerie, and thanks to all posters.

Oh, wait...
HOORAY Mr. Donald J. Trump. Thank you, sir. Thank you, Americans.
Well if your a lawyer I have absolutely no respect for you. I do respect the capabilities of The dhimmicrats to be cunning and evil. It's a respect well founded. Don't assume that they can't throw a monkey wrench into your ‘well thought out’ plans.
Too many republicans are joined at the hip with corrupt democrats. Keep that in mind. It’s not just the democrat party.
Pay attention to what I said before to go away, You are lowering the level of discourse causing others to abandon interest.
I will repeat, you are not contributing anything of substance here. Get control of yourself, watch and learn.
