Former ACORN workers in the city are planning to file a civil complaint against the makers of the video, according to the website Investigative Voice.

City state's attorney Patricia Jessamy said on WBAL's Shari Elicker Show that she could not prosecute based on restrictions for evidence obtained illegally.

Maryland law requires two party consent to be recorded.

Investigative Voice

Former employees of the beleaguered community activist group ACORN are planning to file a criiminal complaint in Baltimore against the creators of the series of videos that have spurred outrage against the organization, knowledgable sources have told Investigative Voice.

The filing could come as soon as Friday afternoon, sources said.

The criminal complaint will allege that recordings of the group’s employees giving advice on how to evade taxes and house underage South American sex workers to journalists posing as a pimp and prostitute were obtained illegally.

The criminal complaint is expected to name both James O’Keefe, 25, and Hannah Giles, 20, along with the owner of the website Breitbart, which initially released the videos.

ACORN is also contemplating a civil suit seeking an injunction aginst O'Keefe and Giles to prevent them from distributing the videos, according to an an email.

Two party consent usually covers all audio recordings...besides phone calls. However, since ACORN was committing criminal activity....dont think O Keefe, Giles would ever get convicted...unless it was a kangaroo court

There are no consent laws for video

That is racist for assuming our first black president and our black AG wouldn’t go after acorn.

This needs to spread to every site online so they can’t possible take all the videos down.

For silent video you are correct. Like security cams. But for video with voice you still have voice recordings that require conset. At least the way I understand it to be.

Their plan must be to ruin them with legal costs”

You know that is not gonna happen don't ya
Joe Wilson says “Hello”.
He's already raised $2 million just from taking on 0bama,,and he hasn't even opened his pile of mail yet, which is expected to add even more hundreds of thousands of dollars to his cash pile.
O’Keefe, Giles, are going to be just fine.
O’Keefe doesn't strike me as a shrinking violet. The guy has got guts, and so does Giles.
I think they are going to come out of this pretty rich, just from book deals alone.

Glenn Beck told us to speak with boldness and ask questions

Glenn Beck ? you need to ask ?
Just what are the laws on the books in Maryland for wire tapping.
Is the ACORN people just pursuing the Straw man ?

Glenn ? you need to ask ?
Do these laws apply to video/audio ?
Or do these laws only apply to phone line interceptions ?
We need some lawyers to look into the laws on the books in Maryland and see what is the actual law in Maryland for wire tapping.
Does it apply to video and audio ? or ? does it only apply to phone line interceptions ? ....

Wasn’t the Baltimore office only run by two women who were interviewed by I think O’Reilly a couple of months ago? One of them was the CEO woman, I remember her face. They talked like they were clueles as a cover.

"I am sure ACORN knows that trials has a discovery process - which means that they could have to turn over a massive amounts of damaging paperwork..."

The fired workers are suing, not ACORN. They are suing because they were allegedly illegally videotapes.

I do not know if this type of case warrants a 3rd party subpoena duces tecum being issued for ACORNs documents. It may take a lot of legal wrangling and will probably fail.

If the Acorn employees are suing as individuals, they won't have dime one to fund the suit. Acorn will have to pay for them....or Soros or some liberal Commie front group.

Fox probably will hire the young couple as independent contractors and fund their defense...or some variation of same. After all, Fox is mightily benefitting monetarily from their exposes. Don't worry about setting up a "legal defense fund" for them. You can bet the two heroes will have the best attorneys in the country protecting them from the infidels at the gate.

This is going to be sooooooo much fun.

MSM is an out of date term. They are not main stream and haven’t been for over a decade.

Try something like PLM ~ Progressively Liberal Mediots

3...2...1 remember the black church burnings?

Expect Acorn to torch their own buildings for sympathy. Good way to take care of evidence while they are at it.

No kidding - you’d think they would be so ashamed of themselves they’d go into hiding. Unbelievable. Now that I think of it, I was stunned that Bill Clinton had the nerve to show his face in public without shame. I guess they really don’t see anything wrong with what they have done - total absence of morals.

Acorn might outfox itself having the fired workers sue...discovery may be ruled necessary up to the date of the termination...let us see how it rolls. The young investigative journalists will not lack for financial support from patriots nationwide...ready to write a check myself.

Petty and retaliatory. There’s no chance in Hell ACORN and it’s workers will follow through to a conclusion but they can force the kids to incur the expense of lawyering up.
