ACORN to sue O’Keefe, Giles, Breitbart; fired workers to file criminal complaint in MD today?

Former ACORN workers in the city are planning to file a civil complaint against the makers of the video, according to the website Investigative Voice.

City state's attorney Patricia Jessamy said on WBAL's Shari Elicker Show that she could not prosecute based on restrictions for evidence obtained illegally.

Maryland law requires two party consent to be recorded.

Former employees of the beleaguered community activist group ACORN are planning to file a criiminal complaint in Baltimore against the creators of the series of videos that have spurred outrage against the organization, knowledgable sources have told Investigative Voice.

The filing could come as soon as Friday afternoon, sources said.

The criminal complaint will allege that recordings of the group’s employees giving advice on how to evade taxes and house underage South American sex workers to journalists posing as a pimp and prostitute were obtained illegally.

The criminal complaint is expected to name both James O’Keefe, 25, and Hannah Giles, 20, along with the owner of the website Breitbart, which initially released the videos.

ACORN is also contemplating a civil suit seeking an injunction aginst O'Keefe and Giles to prevent them from distributing the videos, according to an an email.

Two party consent means that all parties must give consent to be audio recorded (does not apply to video)

The problem Maryland will have in prosecuting is that ACORN has been involved in this activity across state lines....and two party consent is not a federal law.

This ploy by Maryland may be to get ACORN off the hook...in Maryland. Wont help them in other states.

But if they sue in MD under MD law, any adverse ruling would only apply to the activities in MD, not the other States.

In some states it is illegal to record someone without their consent. Typically it deals with voice recording though and not video. So video is often fine but when you have the voice with it...it is illegal.

But don’t confuse that with the law that says it’s illegal to record someone else’s conversation. Like a wiretap listening to two other people’s conversation. Like what the Rats did to the Ohio congressman several years ago.

Gee, isn't that just cute.
In other states like New York, both the Brooklyn Attorney General, and the State Attorney general have launched a criminal investigation into ACORN over their criminal activities.
Meanwhile, in Maryland, the brian dead AG in Baltimore, is more concerned about prosecuting the heros who actually exposed the criminal gang, rather than prosecuting the crminals themselves.
These are the people we should be sweeping from power.

So far as it ends up with these ACORN vermin being thrown into jail for breaking a wide range of laws, including promoting prostitution, tax evasion, child abuse etc, than I am fine with it.

Sorry, but you get taxpayer money, you become a public owned entity, and ANY member of the public should have the right to record you when you are working at anytime and anyplace.

These 'nonprofit' government funded political action committees and 'social justice' organizations are killing us.

WHY should we be forced to fund a political viewpoint of ANY stripe?

Then they should argue freedom of the press. ACORN offices are public facilites (anyone can walk in and conduct business.)

A friend told me the MD law doesn't apply to video it just applies to voice recordings. I’m not sure, because I haven’t looked it up but this guy is pretty reliable.

There is a reason why shows like “To catch a predator” record in certain states. Maryland prefers to protect crooked politicians and pedophiles with laws that require all parties to consent to being recorded. Whereas most other states prefer to protect the people and not the crooks.

My understanding is video without voices is ok, video with voices is still voice recordings.

Dear Conservatives:

These criminal accusations give us the perfect opportunity to no longer associate with these filmmakers or talk-radio. We were getting uncomfortable that these people were making such unseemly accusations through such deceptive means. We can freely ignore all defenders of O'Keefe and his ilk and will gladly inform our members to never bring up this story in public ever again. And we can go back to showing our faces at salons in Georgetown.
