    The 15-year felony charge is a state, not federal, charge and is based on an allegation that he possessed an explosive in a public place, and intended to create harm.

    Assuming that the news stories are true and all he possess were Class C fireworks, the police have a problem. Regardless of how many fireworks he possessed, the statute focuses on the amount of incendiary material contained in an individual firework.

    The overzealous police officers may have trouble getting a conviction. Under Michigan law a “firework” is not an “explosive.”

    Section 29.42
    (a) “Explosive” means blasting powder, nitroglycerine, dynamite, TNT and any other form of high explosive, blasting material, fuse other than an electric circuit breaker, detonator and other detonating agent, a chemical compound or mechanical mixture containing oxidizing or combustible units, or other ingredients, in such proportions, quantities or packing that ignition by fire, friction, concussion or other means of detonation of the compound or mixture or any part thereof may result in the sudden generation and release of highly heated gases or gaseous pressures capable of producing effects damaging or detrimental to or destructive of life, limb or property. An explosive does not include gasoline, kerosene, naphtha, turpentine, butane, propane, wet nitrocellulose or wet nitrostarch containing moisture in excess of 20%, or wet picric acid containing moisture in excess of 10%; or manufactured article such as fixed ammunition for small arms, fire crackers, safety flares or matches containing an explosive in such limited quantity that the collective and simultaneous detonation thereof is incapable of resulting in the sudden generation and release of highly heated gases or gaseous pressures capable of producing effects damaging or detrimental to or destructive of life, limb or property.

    Section 750.243a
    (a) “Fireworks” means a device made from explosive or flammable compositions used primarily for the purpose of producing a visible display or audible effect, or both, by combustion, deflagration, or detonation. Fireworks includes class B fireworks and class C fireworks.

    (c) “Class C fireworks” means toy smoke devices, toy caps containing not more than .25 grains of explosive mixture, toy propellant devices, cigarette loads, trick matches, trick noise makers, smoke candles, smoke pots, smoke grenades, smoke signals, hand signal devices, Very signal cartridges, sparklers, explosive auto alarms, and other similar devices.

    Here is the problem with Adams’ response - There would be no business need for “administration” in the Board of Elections to have access to birth records. The right to vote in Hawaii depends first on residency and secondarily on citizenship. When people register to vote they attest that they are US citizens. The Board does not have authority under HI law or HI administrative rules to access birth records to determine that somebody is born in HI. It has to ask a county prosecutor to do so, and only after a criminal probe has started. A subpoena would have to be issued.

    Certification of Nomination forms are notarized solely to prove that the persons signing the certification are who they say they are (not for truth of the matter asserted).

    Note that there is a sentence added to the Gore/Lieberman cert that was obviously added later (different type face and font). Whether it is present on the original is not clear. Normally, if something is added like that somebody initials the change.

    As an attorney I have to question whether this is a valid notarized affidavit. There is no attestation language where the affiant attests that he is who he claims to be, and states that he was place under oath and that the statements as written are true. Second, the affiant’e signature is supposed to precede the notary’s. Adams’ signature is floating free at the bottom and is meaningless. Further it is not dated. Third, there is no state and county/city byline in the notary’s attestation block.

    This story was originally run in June 2010. A temp worker at the Board of Elections would not have access to vital records held by the Dept of Health, and the offices are not located near each other (Pearl City for BOE and Honolulu for DOH), so it is highly unlikely that he would inteact on a regular basis with anyone in the Vital Records section of DOH.

    Regardless of whether Corsi is generally correct in his assertions, this particularly story is most likely bogus.

    The National Office of the A.N.S.W.E.R. Coalition has received an enormous response from people all around the country who are planning to travel to Washington DC to march on the Pentagon on the 4th anniversary of the start of the criminal invasion of Iraq.

    Huge numbers will come from every major city on the East Coast, Midwest and South - New York City, Philadelphia, Baltimore, Boston, Detroit, Chicago, Cleveland, Atlanta, Birmingham, Charlotte and elsewhere - and from many smaller cities.     Springfield, VA--"Don't touch the Vietnam Memorial Wall," said Tom Poulter, National Commander of the Military Order of the Purple Heart (MOPH), speaking to potential anti-war demonstrators who plan on gathering there on March 17th.
    "Fifty eight thousand men and boys fought and died so you could demonstrate in peace. To dishonor them by defacing the Wall is unthinkable," Poulter continued.
    "We respect the right to demonstrate. We do not respect the right to defile or deface sacred places like the Vietnam Wall. Our members, many of whom were wounded in Vietnam, are outraged that protesters would even consider gathering near the Wall. That is hallowed ground to us who shed our blood on the soils of Vietnam."
    The MOPH commander was livid when he learned of the planned gathering near the Wall to begin an anti-war demonstration on March 17th.
    "It would be best for those people to gather some other place. In fact, there will be many Vietnam veterans guarding the Wall and I can assure you it will not be a peaceful situation should anti-war demonstrators try to damage or deface the memorial."
    "There are those who will demonstrate who are not worthy enough to stand near the Wall, much less touch it."
    The majority of the 40,000 members of the MOPH were wounded in Vietnam.

    Where we will Assemble on March 17

    Tens of thousands of people will be gathering at Constitution Gardens near the Vietnam Memorial prior to the March on the Pentagon on Saturday March 17. This is the same location that ANSWER used for its mass anti-war rally on October 26, 2002. On March 17, 2007 we will leave Constitution Gardens and march on Constitution Ave. and then to Virginia on the way to the Pentagon. We will not be in the Vietnam Memorial and all speakers for amplified sound are turned away from the Memorial so as not to interfere with family members visiting the site. Thousands of veterans and military families, including those who have lost loved ones in Iraq, will be in the front ranks of the March on the Pentagon. Some tiny pro-Bush groups who support the war in Iraq, and who normally mobilize about 25 people to hold signs when massive antiwar protests take place, are now callously trying to manipulate Vietnam veterans by spreading rumors that the March on the Pentagon will defile the Vietnam Memorial. This lie should be treated with the same contempt that people have for the other lies promoted by Bush and his followers to justify an illegal war of aggression: Iraq had Weapons of Mass Destruction; Iraq was responsible for the September 11 attacks; and that the U.S. occupation would be greeted as an act of liberation by the Iraqi people. Enough lies. Enough deceit!

    I am a retired Navy Vietnam-era vet and a Desert Storm vet. Many veterans and supporters will be on hand to defend The Wall, and the call has also gone out to Rolling Thunder. I would like to thank the Freepers for helping us out with this important mission.

    Many of us have been trying to decide the best tactic to use. We can all agree that these idiots deserve to be shouted down, and need a swift kick in the gluteus maximus. But, The Wall is a place of honor and we don't want to disturb the resting place of our comrades, or disrupt any family/friends visiting The Wall. One idea we came up with is to form a defensive perimeter around The Wall and enmass turn our backs to the protesters, maybe standing at attention or saluting our fallen. This would make a powerful statement, and any action against us would be solely blamed on the snivelling whiners and cowards.
