If that decision is not favorable, we will request emergency relief from the Supreme Court,” Liberty Counsel Founder and...

A federal appeals court ruled Monday a COVID vaccine mandate for New York City teachers and other public school workers can go into effect. A three-judge panel lifted a temporary ban on the mandate that was originally set to take effect Monday. “Federal appeals exhausted. Done. The mandate moves forward,” Mayor Bill de Blasio said. The United Federation of Teachers said 3% of teachers (about 3,400) remain unvaccinated. School workers now have until 5 p.m. Friday to get their first dose, or risk losing their jobs, de Blasio said. “If you have not gotten that first dose by Friday 5:00,...

...In a 21-page decision, a three-judge panel on the U.S. Court of Appeals for the D.C. Circuit unanimously ruled that the memo was exempt from disclosure under the Freedom of Information Act (FOIA) on the basis of the presidential communications privilege... The Circuit Court upheld the lower court’s ruling, writing that “records of what was said by or directly to the President lie at the heart of the presidential communications privilege.” The Circuit Court also rejected Protect Democracy’s assertion that the court should make a “narrow exception” and require portions of the memo to be segregated and disclosed ...

A man charged in assisting the chemical spraying of the Capitol Police officer Brian Sicknick on Jan. 6 had been ordered released from jail pending trial, with a trio of appeals court judges ruling the district court "clearly erred" in keeping him jailed. George Tanios of West Virginia was accused of coordinating with Julian Khater of Pennsylvania, who sprayed three officers, including Sicknick, with a chemical spray during the storming of the Capitol grounds. Tanios did not spray any officers and has not been accused of doing so, but he has been held since March by a magistrate judge and...

Last month, the city and county of Los Angeles filed an appeal of a sweeping injunction from U.S. District Judge David O. Carter ordering urgent action to get people off skid row. In their appeal to the 9th Circuit, the city and county asked for the deadlines to be suspended while their appeal is heard. The appellate court didn’t grant that request outright. Instead, the panel of judges paused the order until June 15 and asked for more information on how granting the stay pending appeal sought by the city and county might affect the case before Carter.

Attorney Lin Wood says he plans to file a petition with the U.S. Supreme Court, after a federal court denied his appeal in a case seeking to block the certification of the 2020 presidential election in Georgia.“The stakes are high as the case deals with a disputed Presidential election,” Wood said Dec. 6 in an email to The Epoch Times. “I intend to timely file a petition with the United States Supreme Court.”A panel from the U.S. Court of Appeals for the 11th Circuit on Dec. 5 upheld a Nov. 19 ruling by District Judge Steven Grimberg, a Trump appointee,...

The Michigan appeals court turned down an appeal Friday from President Donald Trump's campaign in a challenge to how absentee ballots were handled in Detroit and other issues. In a brief order, the court said the lawsuit fails because Michigan's election results, including Joe Biden's 154,000-vote victory over Trump, were certified on Nov. 23, a week before the campaign filed an appellate brief. The court said the president's only recourse was a recount, but that has passed, too. “Because plaintiff failed to follow the clear law in Michigan relative to such matters, their action is moot,” Judge Stephen Borrello said...

The propaganda media are trying to discourage Trump-supporters by reporting on court losses for the legal team and emphasizing what they characterize as disorganization among the hastily assembled teams of lawyers. Don't fall for the psy-ops!The mainstream media had a field day yesterday, citing a scathing decision written by a Trump-appointed judge on a three-judge panel of the Third Circuit Court of Appeals, rejecting an attempt to get hinky Pennsylvania ballots thrown out because of fraud. Read Politico's account for a sample of schadenfreude:"Voters, not lawyers, choose the President. Ballots, not briefs, decide elections," Judge Stephanos Bibas — an appointee...

U.S. Sens. Elizabeth Warren and Edward Markey are calling on President Trump to withdraw his nomination for a new federal appeals court judge in Massachusetts, saying it was made during a “lame-duck session” after the presidential race was called in favor of his rival. “Confirming the nominee during this lame-duck session would require Republicans to yet again violate longstanding Senate norms and rules,” the senators said in a statement Tuesday. “The White House should not be using its final days to try to rush through the nomination of a judge who will have a lifetime appointment to a court with...

An appeals court ruled on Friday that Hillary Clinton does not have to testify on her private email system and Benghazi attack records. Judicial Watch in 2015 discovered Hillary Clinton used a private server and blew the story wide open after uncovering emails she sent from a non “state.gov” email account. Earlier this year a federal court ordered a deposition of Hillary Clinton on her emails and Benghazi attack records. Clinton hit back and filed an appeal to stop her court-ordered email testimony. Conservative watchdog group Judicial Watch said it is considering its options. In June of this year, Judicial...

Finally, a semblance of sanity has been restored to the law and Constitution in the misbegotten prosecution of former National Security Adviser Michael Flynn. The U.S. Court of Appeals for the District of Columbia Circuit on Wednesday ordered the controversial lower court judge, Emmet Sullivan, to follow the law by dismissing the false statements case wrongfully brought by the original federal prosecutors who were either incompetent or corrupt — maybe both. As evidence emerged that Gen. Flynn was set up and framed by malevolent actors at the FBI —fired Director James Comey, fired Assistant Director Andrew McCabe and fired counterintelligence...

Everyone needs to cool their heels on this Flynn dismissal order for a bit. While we are all very happy that the three-judge panel of the DC Circuit Court of Appeals ordered District Judge Emmet Sullivan to end his abusive treatment of General Flynn in its order Wednesday, it is a tad too soon to just assume Sullivan will simply accede to the order and dismiss the case. General Flynn himself is on with Rush Limbaugh confirming this is the case as I write this, in fact. Sullivan is clearly a tool of the deep state, and we must remember...

BREAKING: Newly Released Strzok Notes Implicate Obama and Biden DIRECTLY Ordering Sham Flynn InvestigationThe Justice Department released Peter Strzok notes from 1/4/2017 regarding the Flynn-Kislyak calls. Last month it was revealed 2020 Democrat presidential candidate Joe Biden was in a January 5, 2017 Oval Office meeting discussing General Flynn’s phone calls with Russian Ambassador Kislyak with Obama, Yates, Comey, Rice and Brennan. Now we know that Obama and Biden were directly involved in the sham Flynn investigation. Strzok’s newly released notes also suggest the secret Oval Office meeting on January 5 was the reason the Flynn investigation was not closed....

Henderson was the surprise vote.Writing the majority opinion Judge Neomi Rao noted, “in this case, the district court’s...

A federal appeals court on Wednesday ordered a judge to grant the Department of Justice's (DOJ) unusual move to drop charges against former national security adviser Michael Flynn. A three-judge panel on the D.C. Circuit Court of Appeals approved Flynn's petition to intervene in the case after a district court judge had tapped an outside counsel to argue against the DOJ's move.

A U.S. appeals court on Wednesday directed a federal judge to drop the criminal case against President Donald Trump’s former national security adviser Michael Flynn as demanded by the Justice Department, preventing a judicial review of the propriety of the request. In a split decision, a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit ruled in favor of Flynn and the Trump administration in preventing U.S. District Judge Emmet Sullivan from exercising his discretion on whether to grant the department’s motion to clear Flynn, who twice pleaded guilty.

The U.S. Court of Appeals for the District of Columbia Circuit ordered D.C. District Court Judge Emmet G. Sullivan on Thursday to respond by June 1 to former National Security Advisor Michael Flynn’s writ of mandamus petition. On Tuesday, Flynn’s lawyer, Sidney Powell, filed a petition for the writ of mandamus, asking the appellate court to grant the Department of Justice (DOJ) motion to dismiss the charges against Flynn. She also asked the court to take Judge Sullivan off the case, and to vacate his order inviting outside arguments against dismissing the prosecution.Flynn pleaded guilty in 2017 to lying to the...

A federal appeals court on Thursday ordered the judge handling the criminal case of President Donald Trump’s former national security advisor, Michael Flynn, to respond to a request by Flynn’s lawyers to dismiss the case. The order came two days after Flynn’s lawyers asked the U.S. Circuit Court of Appeals for the District of Columbia to drop the case and assign any future court proceedings to another judge. The Department of Justice two weeks earlier made the surprise move to abandon its own prosecution of Flynn, who had pleaded guilty to lying to the FBI about his conversations with then-Russian...
