Legal Tragedy for Unemployed Divorced Men & Fathers

Posted on 08/17/2003 2:34:43 PM PDT by ImFightingMad

I am writing this to make this Legal Tragedy better known and also in hope that someone could help the thousands of us in this tragic situation.

Like many Americans at this time, I have been laid off. This in itself is bad enough for most Americans, but those of us that have been divorced face a Legal Tragedy that is against The Constitution and all moral concepts. Men are almost exclusively affected by what I am about to tell you. This shows the discrimination of the courts and the laws in this country.

Since I have been laid off, I am only “earning” unemployment insurance, which is only 16.6% of my previous gross income. I therefore cannot pay the alimony and child support that the courts ordered in my divorce in Florida. I do not even have enough money for my own expenses. The courts in Florida are looking at finding me in contempt of court because of non-payment. They would therefore put me in jail along with countless others for the same reason. This makes no legal or moral sense in many ways:

1. If I was still married and got laid off, would the courts care, of course not! The family would have to do what they could to survive. But, since I have been divorced, and there is no relationship anymore, I’m supposed to support them over supporting myself, otherwise go to jail. How does this make any logical, moral or legal sense? Why is it that since I am divorced I have a greater financial responsibility than I ever did when I was married? Why should all of my rights be taken away because I am unemployed now, and yet my ex-wife is suppose to maintain the same or better lifestyle as when I was employed? This again, would not be the case if I were still married. This shows that divorce laws take precedence over basic human rights and are stronger laws than marriage itself, which is a bond with God.

2. If I’m in jail, how am I supposed to find a job? After being in jail, it would be very difficult, if not impossible, to ever find a good job again!

3. This type of incarceration was abolished with the 13th Amendment. Which prohibits Involuntary Servitude. Also 8 USCA-56 prohibits Peonage.

Why should my life and other’s be completely destroyed just because we were ever married and now unemployed?

Isn’t the fact that I, and many others have lost our jobs enough of a tragedy in itself? How does completely destroying the rest of our lives solve anything? In this situation, what could any of us ever do to help ourselves?

I was extremely involved in the 2000 Presidential election, supporting George Bush. I lived and worked in Austin, Texas, but I was still a registered voter in Florida. The government and country that I so dearly loved and put so much energy into, has now let me down.

Please Help!

Never had any misfortune in your happy little life. But you feel justified in harshly judging others. How very *Liberal* of you...

Excellent post.

afterall, he believes that men actually love their children just as much as the moms....

What a statement. It illustrates why Dads always get the shaft from the womyn. Take your onerous feminism elsewhere.

im just frustrated with courts in general because no matter who you are its biased one way or the other and its set up to keep the litigation going, why be amicable when you can clean your x spouses clock? those of us that would rather work it out nicely seem to be married to those that have no mercy.

Opposites attract?

I agree this is another injustice caused by the women's movement. I agree that men face discrimination in the courts. What could we do to help you?

but in most cases it's the women and children who get the raw end

Since women get the children in most cases, to me it's hard to see how they get the raw end. Even without any custody paid --- having your kids seems to me like the best part of the deal, even if you have to work two jobs to make ends meet.

I agree with some of what you ahve said, but the wife needs to show the same level of responsibility. If he were still married the family would need to make these plans. It takes two to tango. Women need to be held acountable just as much as men when it comes to children. She may have to get a job and save money and plan for the future too.

Does he owe it to you? Why is that his problem?

So quit whinging. If the deadbeat gave a crap about his kids he'd be living in the same damn state as them. Get a clue.

The children come from the women's bodies. A woman has more physically and emotionally invested in a child that the husband, in most cases.

I disagree with that --- my cousin's wife was having an affair and wanted the marriage ended so she could have her fun ---- he was devasted by the thought of not having his kids to come home to and the idea that they could end up having to live with another man in their house. It seems unfair that the adulterous spouse who ruins the marriage gets to keep the kids ---- and in this case, I know it was the father who had more emotionally invested in the children. The mother was spending her time screwing around, not really caring what was important to her kids.

"Believe it because it happens every day. Get behind in paying child support and it becomes a CRIMMINAL MATTER."

Yep...Child Support Act, passed by both DemocRats and
RepublicRats. ...federal prison for men with debts.

It and other related laws are for the purpose of
removing jobs and voting rights from men. Some of our
leaders think in their own minds that they want harems
and think they can somehow avoid the socialist
consequences. ...sort of an old-f*rt-think on
the part of men who believe they are the benefactors
of all women and that all other men are dogs. Men
like that never really learned to be men. Just look
at Bill O'Reilly. ...bats his eyes several times per
second and mouths-off emotionally, like a girl. He
rants against all men all the time when the subject
comes up. Look at how he sucked-up to Rosie O'Donnell.

Hitlery's coming for them and everything they have, though.
They're going to win the booby prize. About the time
they completely turn our United States into a brothel
of their making, they'll lose their ranches and be hunted
down.

They need our votes. They (our leaders) need to take
good care of us. It's wake-up time for corporate
and investing Republicans who haven't cleansed their
minds completely of "free love"--time to become
conservatives in every sense. They need to bring the
divorce rate to a near halt, right now.

Our leaders should have DNA checks done on their daughters'
panties before they pass another man hating law against
the rest of us.
