Because the recall election petition has qualified, and because an recall election has been scheduled, if Davis quits now, Lt. Gov. Bustamante would become, in effect, the acting Governor of California until the results of the recall election are certified. If the already resigned Davis "wins" the recall, Bustamante would become the full-time Governor immediately (because the office is vacant). If Davis "loses" the recall, but candidate Bustamante wins the plurality, Bustamante would become full-time governor. If Davis "loses" the recall, and someone other than Bustamante wins the plurality, Bustmante would revert back to Lt. Governor.
Although it is not well known, under California law, anytime the Governor is out of the State, the Lt. Governor is Acting Governor, with all the powers and responsibilities of the office.

I didn't know that either.
A hearing was set for Tuesday in a San Diego federal court regarding the way voters would choose a successor to Gov. Gray Davis.
The recall law demands voters choose "yes" or "no" on whether to recall Davis before becoming eligible to choose a successor listed on the same ballot.
The challenge by University of San Diego School of Law professor Shaun Martin and other legal scholars says the process unconstitutionally compels voters to choose on one matter to gain eligibility for another.
"A voter may have no desire to vote regarding whether to recall Gray Davis but nonetheless feel strongly -- and wish to vote -- about the identity of the new governor of the state of California," Martin said.
The California attorney general's office supports the requirement.
"Allowing voters to abstain on the recall question would allow those with only an indirect or remote interest in this crucial question to decide who will replace a recalled officer," said Deputy Attorney General Leslie R. Lopez.

More specifically, and to the best of my knowledge, Bustamante would become governor temporarily, until the day after the recall vote. If the recall failed, Bustamante would remain governor for the remainder of Doofus' term. If the recall succeeded, then the winner of the recall would take over on Oct. 8.

Didn't Mike Curb have a lot of fun with that? I dimly recall him appointing judges or something like that when Jerry Brown was out of state.
