Seems to me Hollings of SC (up for re-election in 04) expressed support for Estrada. Whether he votes for cloture is another story. Other Dem Senators up for re-election in 04:
Can he vote against cloture, and then come out and say if it would have come to the floor, I would have voted for Estrada.

Seems to me that of that list, Graham, Feingold, Dorgan and Bayh could play the moderate, for Estrada.

And of that list, a certain Sen. Graham would like to run for President. If I were a Presidential candidate, I'd rather have a nominee I didn't like get through (GOP House, Senate and White House - what could I do??) than have the word "filibuster" appear next to "Hispanic" in an opponent's commercial.

Thanks Leni-I really believe this. I believe that that horrid word and all it represents is the final nail. It is time to question whether these democrats simply do not want the vote because they are truly anti-Hispanic. They need to ask um why they are acting so anti-Hispanic, when all the information they need has been vetted? That the only logical conclusion possible is that they do not want an Hispanic sitting in that judgeship. After all, surely they would not use political posturing to character crush a good, Hispanic American, would they? What other conclusion could be drawn? The stuff would hit the fan...and in the end....we could beat them back with the horrid rhetoric they so frequently use.

They are acting like racists. Racists can never justify their stance. And the dem senators seem to be having that very problem.

Let them keep going.

Hillary will become known as the "OBSTRUCTIONIST CANDIDATE" in 2008 and they'll have to take her out of the race. That's one huge negative!!

Sure. What's a little hypocrisy among Senators?

"While I find Mr. Estrada to be well qualified, I was indeed concerned about his unwillingness to answer the questions of my colleagues. Blah, blah, blah..."

Ya know-it is going to be an interesting vote. Overwhelming in favor, of course, but ohhhhhhhhhh what will Leahy, Durbin and Reid do? Hehe. I don't think Frist is going to allow the dems to ruin the nomination process for lower federal court nominees. This is going to a real expose on just how low the dems can go.

Do we ned 60 to break the filibuster or do they need 41 to keep it going?

We need 60 votes. The rule says it requires 3/5 of the total number of senators to invoke cloture, not 3/5 of the number of senators present and voting.
