FOX just reported that the paperwork will be ready to go on the New Jersey funny business and rigging elections.

Depending of course if the Torch goes throught with the resignation from the campaign or U.S. Senate.

Hell yes we will be in court. These types of shenanigans are clearly New Jersey law. In addition, any plan that postpones the election is patently illegal under federal and constitutional law.

What should be clear here is that there is one party out there that is hysterical about KEEPING POWER. And their symbol, fittingly, is an ass.

Here's the appropriate code. It looks as if the Demorat governor can appoint someone to fill Toricelli's seat after the 30 day marker, and no election would be held for that seat until NEXT term.

NJ State Law.19:3-26. Vacancies in United States senate; election to fill; temporary appointment by governor If a vacancy shall happen in the representation of this state in the United States senate, it shall be filled at the general election next succeeding the happening thereof, unless such vacancy shall happen within thirty days next preceding such election, in which case it shall be filled by election at the second succeeding general election, unless the governor of this state shall deem it advisable to call a special election therefor, which he is authorized hereby to do. The governor of this state may make a temporary appointment of a senator of the United States from this state whenever a vacancy shall occur by reason of any cause other than the expiration of the term; and such appointee shall serve as such senator until a special election or general election shall have been held pursuant to law and the board of state canvassers can deliver to his successor a certificate of election.

Good thing those corrupt slimeball bastards of the NJ GOP did their best to undercut Brett Schundler's campaign. Oh my, how the dynamics would change if Schundler were governor now, instead of McGreevey.

New Jersey citizens have a federal and constitutional right to vote on November 5th. Any game to postpone the election should will be shot down by the courts. Hopefully, Scalia has his injunction pen ready to go.

First of all...it is still OUTSIDE the 30-day mark. From the WNBC article earlier, if he resigns the Senate today, then they can run another candidate.

If he stays in the Senate, but withdraws from race, they cannot run another candidate.

A lot of the reason Dubya won in Florida was that Jim Baker hired all the leading election lawyers in the state right after Election Day 2000. Kept them all from working for Gore -- including the Dem lawyers, like Barry Richard. With their money advantage, the Republicans now need to do the same in NJ.

They should stay all over this issue. I would not put is past the dems to have realized that "Mr. T is not going to win, so how are we going to retain his seat?"

It's pretty obvious that the dems are going to try to throw someone in at the last minute who they think wil have a good chance against Forrester. OR, they might try to pull some B.S. utilizing some obscure law that allows the Governor of the state to get involved. Anyone who thinks that this is a last minute development has a lot to learn.
