A 12-year-old boy says he was brutally attacked by a classmate armed with brass knuckles.
The family of the 12-year-old victim is speaking out, saying not only was their son bullied and attacked, but they also allege that the school failed to protect him.
What they're saying:
According to the family, Damian had been bullied by another male student all week. It was the first week of school for students at James A Foshay Learning Center in Exposition Park.
It started as taunts and pushes but quickly escalated.
On Friday, Aug. 22, Damian said the bully pulled him from class. Damian said his teacher told him to go — so he did. Within minutes, he was ambushed by his classmate as the bully's mother watched the attack, and allegedly supplied her son with the brass knuckles, the family said.
Damian's family said the principal eventually showed up.
"He kicked me, but the principal already had him in his arms," Damian said.
"I was so heartbroken. I was crying. There’s gaps in his memory. Headaches, constant headaches. His eyes hurt. His ribs and stomach hurt because he got kicked," said Damian's mother, Catalina Vasquez.
What's next:
They say Damian’s long-term prognosis for his health is still not known. He can’t eat solid food and has nightmares about the alleged assault.

Mom must feel grateful it was in Los Angeles where the crime rate is going down and Newsom is protecting everyone.

I was bullied in the 7th grade by a thug and his three associates. He had been in a juvenile correctional facility.
I never forgave the classmates surrounding us and just passively watching. No one intervened. I’m 79 and still holding the grudges.
The only time I genuinely wanted to murder someone was a bully in middle school. But we got him arrested when we let the school know he was selling dope on campus. I remember walking past the office while he was sitting there with the cops crying and we pointed and laughed. I never hated someone as much as I hated that guy.

Since when does a teacher let one student out of class because another student came and said we need him. I never heard of such a thing. It is ridiculous. Secondly why would the student go with someone who has been bullying him for a week?
One reason the school failed to protect him is that teachers are not allowed to do anything when students get violent.
You got that right. Nightmares, can’t eat solid food, long term prognosis unknown. All over a fat lip. No missing teeth no bone fractures on the face. Not even a black eye. Brass knuckles are hard core and do real damage, I personally call BS on this kid’s condition, Your mileage may vary.
Ah, middle school. Everyone hates it (most of the people I know). I was a nerd, a geek, in middle school. My favorite tool was a pencil, which I kept sharpened. One bully picked on me, pushing and punching. That ended when I put my pencil to work, got his arm good. I ended up in the principal's office, got let off with a warning. That bully never bothered me again. Later in life had a good laugh at watching John Wick - pencils come in handy from time to time.

How did the mother watch the attack? Was she at school?.. How did the perp convince the teacher to make Damian go with the perp?
Sounds like lots of legal stuff. Perps family going to be liable. School might be liable.
Jail time , expulsion, and monetary damages. In the meantime, Damian, as soon as you get better, learn aggressive self defense, learn how to make a zip gun, carry a stainless steel sharpened knitting needle along the leg seam line in your jeans. And super duper strength or homemade capsaicin spray.
