BREAKING: Biden Judge Rules Trump Firing Democrat FTC Commissioner Illegal

A federal judge on Thursday rehired the Democrat FTC Commissioner who was fired by President Trump earlier this year.

US District Judge Loren AliKhan, a Biden appointee, said President Trump’s firing of Rebecca Kelly Slaughter, the Democrat FTC Commissioner was illegal.

The Trump Administration will promptly appeal this order.

Politico reported:

A federal judge has restored commissioner Rebecca Kelly Slaughter to her role at the Federal Trade Commission, ruling that President Donald Trump’s attempt to fire the Democratic appointee in March was illegal.

U.S. District Judge Loren AliKhan issued the order on Thursday, saying that the Trump administration’s firings violated the FTC Act and protections under a 1935 Supreme Court precedent that prevented a president from unilaterally firing officials at independent agencies.

“Because those protections remain constitutional, as they have for almost a century, Ms. Slaughter’s purported removal was unlawful and without legal effect,” AliKhan wrote in her opinion.

In March President Trump fired both Democrat commissioners at the Federal Trade Commission (FTC).

And they both sued to get their jobs back.

“President Donald Trump fired two Democratic commissioners at the U.S. Federal Trade Commission on Tuesday, in another major test of the independence of regulatory agencies,” NBC News reported in March.

“A White House official confirmed the firings of Democratic Commissioners Alvaro Bedoya and Rebecca Kelly Slaughter after they were first reported by Reuters, but had no additional comment,” the outlet reported.

“President Donald J. Trump is the head of the executive branch and is vested with all of the executive power in our government. I have no doubts about his constitutional authority to remove Commissioners, which is necessary to ensure democratic accountability for our government. The Federal Trade Commission will continue its tireless work to protect consumers, lower prices, and police anticompetitive behavior,” Andrew Ferguson, Chairman of the FTC said in a statement.

“I wish Commissioners Slaughter and Bedoya well, and I thank them for their service,” he added.

Okay, so transfer her to the Yuma, NE office and adjust her salary to match the demographics. No office there? Rent a room, wait for the call. If she complains, Send her to open an office in Ruby, AK in January.

Not quite yet.

There is a Supreme Court precedent still out there that maintains some limits - the case is called Humphrey's Executor if you want to Google it. It is kind of the last bastion still standing. It basically says that the President can't fire at will members of multi-person boards that exercise quasi-judicial or quasi-judicial power, as opposed to primarily executive power. The Supreme Court has chipped away at that, but it is still valid precedent as of right now.

And don't blame me - I didn't write it.

The real issue here is the Federal Reserve Board, which the Supreme Court even recently has strongly suggested would be covered by Humphrey's Executor. So the question is going to be whether the FTC is more like the Federal Reserve, or more like the NLRB.

Case was destined to go all the way up, and needs to be resolved by the Supreme Court. But as much as I dislike the decision, I can't honestly say the judge wasn't following precedent, which is their job

It would be great if Congress would explictly define Natural Born Citizen (I favor the idea of both parents being US citizens at the time of the child’s birth on US soil). And then state (again) that the President must be an NBC and that all federal judges must also be NBC. Congress could do this. But won’t.

Fine her new job should have strict hours of 3:00 am to 1:00 pm Sunday to Thursday. Her role will consist of placing ping pong balls in boxes, carefully counting how many went into each box. After filling a small warehouse with the boxes of the ping pong balls. Her next task will be to audit the total ping pong ball count by opening each box, recounting the ping balls, resealing the box, and completing a forms to track all the activity. Once this process has been completed, she can move on to different sized boxes and colors of ping pong balls.

While she works the song ‘MacArthuur Park’ will be played on an endless loop.

So now we have five co-equal branches of government, with the executive not on that list. Amazing.

I don't know how fedzilla works, but working for any company where any manager doesn't want you there is not where you argue to keep your job. Perhaps among the Beltway bureaucrats, it's a resume enhancement?
