I just saw it. The cops played their game. Penny thought he was fine and got comfortable with a fellow Marine. NEVER EVER talk to police (in that vulnerable position) without a lawyer.

The cops are just mad because he did something besides eat donuts, get a city pension and a fake disability to retire early like most NYPD.

Never talk to a cop. Ever, never …. Just say “lawyer” and then “I plead the 5th and want a lawyer.”
You have to actually say “I’m not willing to talk to you”. OUT LOUD. There was a court ruling that said complete silence without invoking your right to refuse can be construed as obstruction.
The only friends you have are a lawyer and Jesus.
And these asshole wonder why nobody steps up and stops a stabbing or mugging.
Call 911…. Wait for an hour and watch the donut patrol drag their clipboards and yellow tape to fight crime. … pose with their special ops gear and congratulate each other for “getting home safely”.

Guy should have never been arrested.
Bragg decided to prosecute Penny because of agitation by Al Sharpton. The other man involved was a black man so he was let off in return for agreeing to say what the prosecution wanted him to say. Everything about the case is racial--except that the crazy guy was threatening to kill everyone in the car including the black people.

Once a Marine always a Marine. So, the saying goes.
These are the only things you should say to the police.
1. Am I free to go? If the answer is yes, leave. If the answer is no move on to number two.
2. Am I under arrest? If the answer is no, repeat question one. If the answer is yes move on to statement 3.
3. I will be invoking the fifth amendment until I have consulted with my lawyer.
4. Shut up. Do not talk. Do not make any further comments to the police. Just shut up.
The police are your enemy. Treating them any other way when you are being "interviewed" is just weaving a noose for your own neck.

Anything you say will be used against you but NEVER for you. The cop's job is to put you in prison. The cop is allowed, even encouraged, to LIE TO YOU in order to put you in prison. Not only should you not talk to them, you shouldn't believe any words, phrases, or even inarticulate grunts that emanate from their mouths.
Two common police interrogation techniques:
“I want to hear your side of the story.”
“Help me to understand what happened here.”
What they really mean:
I want to hear your side of the story, so I can arrest you.
Help me to understand what happened here, so I can arrest you.
Honest people who have good hearts are eager to talk to the police because they think that the police are the "good guys".
Back when I first came back to the states my cousin, who was the local sheriff sat me down and explained that I was not to ever talk to the police without a lawyer. I asked, "but what if I didn't do anything wrong?" His answer was "especially if you did not do anything wrong."
