Special counsel Jack Smith has charged former President Donald Trump in a superseding indictment in his federal election interference case.
"Today, a federal grand jury in the District of Columbia returned a superseding indictment, ECF No. 226, charging the defendant with the same c, riminal offenses that were charged in the original indictment," a Justice Department spokesperson said Tuesday.

I'm not that pessimistic now--I think Trump has some chance. But the odds are in favor of Democrats pulling off another steal.
Of course, if they manage to kill Trump before Nov. 5, who knows what would happen? Would that turn enough voters against the Democrats? Would Vance then be the Presidential nominee or would the RNC substitute someone else (and keep Vance as VP)?
That’s not double jeopardy. There were no charges that completed adjudication where he was acquitted or charges were dismissed with prejudice.

Doesn’t this give the Trump legal team to have the superseding indictment thrown out as it was filed by someone who is not properly appointed special counsel?
That is one argument that can be made. Smith lacks standing.
Jack is an a**hole - pure and simple.
If they were dismissed with prejudice, and the charges are brought again by the same disqualified prosecutor, maybe it’s not double jeopardy, per se. But it’s still just as defective for the same reasons.

Congress never approved him. So Jack is operating outside the law, and he knows it. He should be disbarred for it.

Nope he lost the Florida case and the DC case because of two reasons. The first being was he was never appointed to Special Counsel by Congress. That’s the law and he is operating despite what it says.
Furthermore, you have the Supreme Court ruling too that Presidents operating under the official office of the Presidency cannot be held legally or criminally liable. Every President from George Washington has had if.
The fact Jack is doing this means he is ignoring the law and the Supreme Court ruling. He should be disbarred.

Wrong case. This is the January 6th case which was always in DC where the crime was committed (their wording).
