Many prominent Court reform proposals from recent years fall into two main categories: those that would change the size of the Supreme Court (sometimes called “court packing”) and those that would impose term limits or age limits for Supreme Court Justices. Congress has broad authority to set or change the size of the Supreme Court through ordinary legislation, but implementation of term or age limits would likely require a constitutional amendment.

Biden is a crazy old man yelling at clouds when it comes to putting term limits on the Supreme Court. I can imagine the glee that the Supreme Court justices would have in ruling it unconstitutional.

We've had a couple of examples of Article III judges outstaying their welcome on the federal courts - David Edelstein and Dickinson Debevoise.

Not the Supreme Court, of course - but good examples.

I’ll bet the split on the decision against term limits would be 7-2 with Sotomayor and that new justice voting in favor of term limits.

That would be like Congress blocking the passage a proposed amendment to repeal the 17th amendment.

Division of Power/Checks And Balances... hello???

It is bad enough that idiots passed the 17th Amendment. There was great wisdom in Senators being chosen by state legislatures - it was all part of that great balancing of the system. But $$$ spoke louder - and disinformation/fake news/propaganda...

With the current focus on returning to constitutional originalism Biden’s attempts to redesign our form of government are going to hit a wall.
Originalism is the legal theory that bases constitutional, judicial, and statutory interpretation of text on the original understanding at the time of its adoption

Sotomayor is allegedly in poor health so her term may end in the near future. As for the “ new justice” perhaps there should be a minimum IQ limit.

All this spewed stuff from democrats, which has not been spewed before Obama, is ridiculous.

As far as I have experienced, once Congress installs a judge onto the Supreme Court, that judge enters the judicial branch of gov’t., and shall not be trucked with.

Today, we have the knockkneed bucktoothed communist bartender attempting to truck wwith the Supreme Court!

The three branches have never been equal in power. Legislature, Executive and then Judiciary - in that order. Leg. can limit or impeach & remove members of other branches. They can cut off funding. The Founders could not foresee the power-hungry Congress we have now.

The Biden handlers are reaching for straws. They are trying to get their base excited over something. Anything at all! Nothing is working so they are suddenly going to try to convince the college-educated liberal screeching white women (about the only group still voting for them) that the Executive Branch can just wave a magic wand and add a few Justices to the Supreme Court. They can’t.

The Congress is too divided to impeach any Supreme Court justices for what ridiculous things the leftists Democrats think are impeachable offenses.

I’m open to term limits on Supreme Court justices as long as we pass term limits for Members of Congress first.

Tone deaf Republicans need to link the issues.

I am totally against increasing the number of justices on the Supreme Court.

However, I would get a great deal of pleasure from Uncle Joe increasing the head count and then President Trump is the guy filling the vacancies.

I definitely think tightening up some ethics wouldn’t hurt. They are paid well for 9 months of work. I’d say they should be under the same 10 dollar gift max as the rest of the federal government. No trips, no staying at homes, no paintings, ect. Definitely no foreign travel or gifts.

Correct. The legislative branch can alter the size of the USSC by adding justices at any time. However, they cannot shrink the size of the court except by death, resignation or impeachment. After such a death, resignation or impeachment, they would need to pass legislation to redefine the number of justices. And if the president is hostile to such a move, the legislature would need to be able to muster to votes to override a veto.
