A Palm Bay, Florida Homeowners Association board member was arrested last month after allegedly pulling a gun on three kids fishing at a lake in his subdivision, taking their equipment and throwing the rods, reels and tackle into the woods..

Police charged 57-year-old Kyle Patrick Tate with criminal mischief and grand theft as a result of the incident.

A court affidavit filed in Brevard County, Florida alleges that on April 14, officers with the Palm Bay Police Department were dispatched to a suspicious incident at Stillwater Lakes, a subdivision owned and managed by an HOA.

FOX 35 in Orlando confirmed Tate is the president of the community’s HOA.

The responding officers spoke with three kids who were fishing on the south side of the lake in Stillwater Lakes, who said a man, later identified as Tate, walked up to them while holding a firearm and telling them to get off his property.

But the property belonged to the HOA, not Tate, according to police.

Still, Tate grabbed their fishing rods, reels, tackle boxes and other equipment, before throwing the equipment into the woods and damaging them.

The kids told police they estimated the fishing rods and reels to be valued at $1,900; the tackle boxes and lures inside to be valued at $150; and cast nets to be valued at $150.

Tate also allegedly took a phone valued at around $1,500 from one of the kids, which has not yet been recovered,

In our neighborhood, even if it’s common area, they still should be told to leave, we have signs in our common area lake that say, No Boating, No Swimming, and No Fishing, and it’s all for liability reasons, yet I’ve seen kids fishing right next to the signs that say No Fishing.

It was my upbringing, my father would have given me a good beating for being on someone else’s property without their permission, I grew up in a farming area, the farmer would not have noticed 1-2 watermelons missing out of a field of over 100 acres of watermelons, if I got caught, I could have been shot at and then given a good beating from my father.

There is no logical reason for being on someone else’s property without their permission, kids don’t really know any better because their parents allow it and don’t teach them about personal property rights and the consequences of not listening to your parents.

I think you missed something. The property belonged to the HOA, not the perp. And even if they were trespassing pulling a gun and robbing kids is not a commensurate response.

I have already said pulling the gun was stupid, I haven’t missed anything, if the HOA owned the property that means that particular owner was a part owner, because his dues are part of the HOA.

In my case, our HOA has signs all over the place in our community lake which state, No Boating, No Swimming and No Fishing, all for liability reasons. Yet, we have kids all the time fishing in the lake right in front of signs that say No Fishing.

It’s likely this particular HOA had similar signs or a rule against fishing in a common area, which if true it’s incumbent on the owner to tell the kids to leave.

I have personal experience in this matter, my wife and I own a 2nd residence which is a condo, there is a community pool that has a sign indicating no trespassing, Owners and invited guests only. One day my wife and I arrived at the condo and two women and their kids were swimming in the pool, no one knew who they were, we called the local police to come out, they ran them off and told us the people were from a nearby town and wanted to swim because it was hot, there were not owners or invited guests, they had to go immediately, if someone got hurt or drowned, they would sue the crap out of us despite being in an area that was prohibited to them.

My limited experience is that people who want to be HOA presidents tend to like power over others, even if it is in a pathetically narrow sphere.

Maybe. But graduation from law school would make him older than most. Would graduating from law school at 27 or 28 be normal or too old?

I would never kick out a couple of kids fishing in my HOA pond or anywhere else for that matter.

I'd rather see them fishing than sitting at home playing video games.......

These monied northern retirees come down here and start setting up the type of system they ran up north for decades which they used fleece their serfs to enrich their estates.

Of course your example would be flagrant trespassing. But the story here is unclear about whether the kids were actually trespassing. What is the definition of that in this jurisdiction--where a body of water is owned by a group entity such as an HOA or a local or national government? As I recall, a coastline within a certain distance from the water can be open to visitors passing through, or even fishing, and I've seen it apply to lakes.

The law is not cited here at all, whether concerning possible trespass, possible violation of gun regs (spit!), or menacing others with a gun without a proper legal justification--such as an alleged intruder who poses an immediate physical threat.
