The rape conviction of movie producer Harvey Weinstein has been overturned by New York's highest court.
The New York Court of Appeals, in a scathing 4-3 opinion, overturned Weinstein's conviction on sex crimes against three women, finding the trial judge "erroneously admitted testimony of uncharged, alleged prior sexual acts against persons other than the complainants of the underlying crimes."
The court said that testimony "served no material non-propensity purpose" and "portrayed defendant in a highly prejudicial light."
Weinstein spokesperson Juda Engelmayer told ABC News, "We are happily surprised and we are studying the ruling."
The Weinstein team, which was eagerly awaiting a ruling, was not expecting it to be in Weinstein's favor after a succession of rulings in different courts all went against Weinstein.
Weinstein was also convicted of sex offenses in Los Angeles and sentenced to 16 years in prison there.
Because Weinstein is already convicted in California, he will not be released, but instead transferred to the custody of prison authorities in California.

The one positive about the Weistein case is that Hollywood got caught with their pants down after enabling this guy, praising this guy, and always stating silent and playing along (they all knew, many participated and benefited) so they went into emergency 'it wasn't me' mode. The result: they destroted all their major blockbusters franchises by centering them on female mary-sue flawlessly perfect and powerful princesses fighting off big dumb male chuds and lost billions upon billions from it. So something good did come of it.

So you think if you are on trial, a parade of women not involved with the case and with no legal case of their own, should be able to come through and say you assaulted them decades ago without the slightest evidence?

Speaking of that, you can skip Ghostbusters. Don’t go thinking it’s a Bill Murray movie. He has a very minor cameo with a couple of lines. I’s a 16 year old Mary Sue and her multicultural friends, she having a lesbo affair, and saving the day when everyone else including the OG Ghostbusters fail. She does it with one of her many amazing Sheldon Cooper science hacks.
And there is no comedy, and the soundtrack sucks too.
Total bummer.

I would not be surprised that some of the Appeals Court ruling may be used by Trump.

“We think Johnny robbed three banks last year. Therefore, he must have robbed this one because that’s the type of guy he is.” type of evidence.
This is called character evidence. It’s always inadmissible unless to show a common plan or design [and no, committing similar crimes doesn’t qualify]. Virtually never admissible in a criminal case. Judge knew this and should never have allowed this evidence. Guaranteed a reversal. Stupid, stupid man.
The Weinstein thing always felt like a rioting mob to me. No doubt he is a despicable human being, but the “justus” system is, without a doubt, driven by “optics” rather than the rule of law these days.

Most of it was. Harvey Weinstein was a fat, ugly man who compelled beautiful young women into having sex with him in exchange for a shot Hollywood fame and fortune.
But when he wasn't engaging in the casting couch, a loathsome but perfectly legal activity, there were some compelling accusations that he committed actual "rape rape" and that's what he went down for.
Why, when he had plenty of consensual albeit disgusting and regretful sex with young beautiful aspiring starlets?
Probably the same reason Ron Jeremy did. He let his power get to his head.
Anyways, we're all the worse off for it. Weinstein and his ilk made great movies. Today, Hollywood has been effectively longhoused. It has become the abode of busybody Karens wielding power at every corner, writing lousy scripts, directing lame, boring films, and casting ugly actresses.

Ny may be a joke but the ny court of appeals made the right decision. Even the most vile person deserves a fair trial. A trial based on facts not character assassination. Same as Trump deserves a fair trial.
Some good movies, but Harvey bribed or cajoled awards out of the Academy for some not so good ones. Also, the movie industry was more creative in the 90s. It’s not like Harvey would be making masterpieces in today’s tired Hollywood.
I agree. But what made it a joke, IMHO, was how it exposed the widely disparate treatment of Weinstein vs. Trump. Particularly on the E.Jean Carroll case, which was absolutely ridiculous.
They were still making good movies and television a decade ago. #MeToo and #OscarsSoWhite killed everything.
All the straight white male screenwriters were fired. All the straight white male everything were fired (though a few may still work on set construction). Women took over the whole industry. Everything became "gay and lame" (as the kids say today).
