The Brooklyn straphanger who shot a berserk rider attacking him on a rush-hour train Thursday will not be charged, prosecutors said Friday.
“Yesterday’s shooting inside a crowded subway car was shocking and deeply upsetting,’’ Oren Yaniv, a spokesman for the Brooklyn District Attorney’s Office, said in an an e-mailed statement.
“The investigation into this tragic incident is ongoing but, at this stage, evidence of self-defense precludes us from filing any criminal charges against the shooter.”
The shot man, Dajuan Robinson, 36, had bought the gun on the train and whipped it out during his attack on a stranger, who shot Robinson in the head as the pair wrestled over it.
Robinson is hospitalized in critical condition.

Except in very rare circumstances, as in mechanical failure, guns “don’t just go off”. Someone’s finger was on the trigger, And actuated it.
Well, I got a bum steer from an earlier report.
Regardless, the non-charged person is Hispanic, so my point remains.
“who merely put an aggressive and violent felon in a chokehold”
merely?
he killed him.
FREE DANIEL PENNY!!!
The attacker was black. A big reason is this happened in Brooklyn rather than Manhattan. Different DAs.
“Journalists, please, use, commas, sparingly.”
They must have studied punctuation at the same school as certain, Freepers, who predictably use a, ton, of commas, often and in, inappropriate places and usually throw in, several incorrect use’s of, possessive pronoun’s.
Damn straight - it’s because he’s not one of them.
When I try to use voice to text on my iPhone with voice, it constantly puts commas everywhere. In fact the previous sentence has a comma that was put in by my iPhone..
Yes.
Well, of course. Where else do you expect to buy a newspaper, a soda, candy, or a gun?
or doobies.........................
That’s interesting. My cheap Android phone regularly misunderstands my voice-to-text but at least it keeps its commas to itself.
Comma si, comma sa.
Ok, I looked it up and there is a setting under ‘Keyboards’ named ‘Auto-Punctuation.” it must’ve appeared sometime when my iPhone was upgraded.
I just turned it off because, like I said, it is comma crazy.
Lol - exactly.
Yes, of course. We don’t know who’s finger was on the trigger. Presumably the person who pulled it but that’s just a guess. I can imagine the intended victim grabbed and twisted his hand and arm, causing the trigger pull.
Gun safety - don’t put your finger on the trigger unless and until you’re going to fire it!
There is more to this from reports I’ve heard or seen... that the man was highly aggressive. I don’t know what his intentions were or why he needed a pistol for this situation. A little scuffle between two men doesn’t seem to warrant the pulling of a gun. And armed robbery on the packed train car doesn’t make a lot of sense either. But I guess if he was thoughtful and conscientious he wouldn’t have a hole in his head right now.
Good find!
He “whipped it out “?
“Newcomer” get’s no charges.
I’m groovy with that, man did the righteous thing.
But, if he was a Whitey McWhiteman, there would be cuffs, charges, followed by jail time.
n u no it.
thx
