MSNBC Legal Analyst Patiently Explains Why Special Counsel HAD to File Biden Report to Angry Morning Joe Crew

Former U.S. prosecutor Chuck Rosenberg knew that defending the Special Counsel report on Biden docs would make him “unbelievably unpopular” on Morning Joe, Friday morning.

At issue is the report from Special Counsel Robert Hur, which concluded President Joe Biden should not be charged for his mishandling of classified material in no small part because of his mental decline, describing the commander-in-chief as “a sympathetic, well-meaning, elderly man with a poor memory.” ,p> The hosts and assembled pundits of Morning Joe were nearly unanimously in contemptuous agreement that Hur’s report unfairly included “gratuitous” partisan shots at Biden because the Trump-appointed U.S. Attorney was a “Trumper” who put out “garbage.” They were angry.

There was one outlier on Friday morning’s show, however, and it was the one guy who actually knew what he was talking about, though he was well aware of the mood of the room. “So let me start down a path, Willie, that will make me unbelievably unpopular this morning,” Rosenberg started.

On another note, did anyone notice how easily the Conservative Pundits and the GOP fell for the subtly crafted change of focus?

Namely, the real issue of the report is that BIDEN BROKE THE LAW!!! It didn’t exonerate him. BUT, the reason his law breaking doesn’t face criminal prosecution is that he has LOST HIS MIND.

Very few of the pundits (with exception Turkey and VDH) focused on the fact that the man broke the law. Instead, they went straight for the senility focus.

That, to me, is a trap. The first part is as important as the second. Biden broke the law and, unlike Trump, he did not have a colorable defense for having done so. The Special Prosecutor’s finding clearly and unambiguously state that.

Now, we have surrendered a key part of the narrative. A part that is curcial to focusing on just how two tiered our justice system is.

I disagree, the special counsel’s report put a spotlight on Brandon’s senility, and yes he was not charged, but the legal question is if a sitting president can be prosecuted.

Biden had more files than Trump.
Biden had files of a higher classification level than Trump.
Biden stored his files in a far more irresponsible manner than Trump.
Biden illegally took classified files when he was a senator and vice president — no legal justification at all.
Trump was president, with the power to declassify any and all documents and keep them as personal property just because he wanted to. He could do that.

No charges for Joe (he’s senile).
I still expect charges for Trump (he’s a threat to “Our Democracy”).

Yes, it did put a spotlight on that. But it also put a spotlight on the fact that his senility was what kept him from being charged with a crime THAT HE COMMITTED.

There is a huge difference between being cleared of any criminal conduct and being found to have committed criminal conduct. BUT EVEN THOUGH Biden committed a crime, not being charged due to his mental capacity. Two for one right there.

As far as charging a sitting President. That is just awesome for Trump given the case in the DC circuit. He may be sitting, but the crimes Biden committed were not done when he was President of anything.

So Trump can be charged with crimes based on actions he took while President. But Biden can’t be charged with crimes he committed wile not President because now he is. And Smith is arguing immunity isn’t absolute? Ok then, Biden hauled out of the White House please, or at least indicted NOW, and tried the second he leaves.

I see it different. They were ready to defend Biden being different than Trump on this issue and that it was already accepted more or less. The idea that he was not only guilty but senile was a broadside that was not expected and one that will resonate in a wider sense.

The fact that a DC jury wouldn’t convict Biden because he is a ‘sympathetic figure’ should be emphasized.

From the report:

“Our investigation uncovered evidence that President Biden willfully retained and disclosed classified materials after his vice presidency when he was a private citizen. These materials included (1) marked classified documents about military and foreign policy in Afghanistan, and (2) notebooks containing Mr. Biden’s handwritten entries about issues of national security and foreign policy implicating sensitive intelligence sources and methods. FBI agents recovered these materials from the garage, offices, and basement den in Mr. Biden’s Wilmington, Delaware home.”

They concluded he committed the crime and refused to prosecute. This wasn’t a written as a mental health evaluation. It just turned out to have that aspect to it.

Yup, and many did last night. Not VDH and not Turley and not Newt. Biden is a criminal and tried to get out of being prosecuted by relying on the fact that he is mentally incapacitated. The Special Counsel pinned that defense to him and made him live with it, which is a cherry on top of this cake.

Say it again and say it a lot. Biden broke the law and did so with intent. I think that is why they couldn’t roll out the Comey Special “No Criminal Intent” to issue a decline to prosecute statement. The report says he willfully did it. That was out the window.

Some previous democrat presidents, Wilson. FDR, Clinton, and Biden, they all had wives who loved the power and money and stood by them.

Ken Starr exposed Billy J. Clinton got a bj by a White House intern in the oval office and lied about it, yet the American people shrugged it off, it was just about sex, most said, hey the economy is good, they said. Hillary was humiliated, but she did not care.

Now with a bad economy and Biden's obvious senility, I believe that resonates.

I think deep-down the Democrats were hoping he would be indicted. Now removing him is harder, and now it’s out there that he’s a vegetable. The worst-case scenario for them.
