Texas Vows to Defend Its Sovereignty, Oppose SCOTUS Ruling

Texas Attorney General Ken Paxton vowed to defend the sovereignty of the State of Texas after the U.S. Supreme Court issued an order on Monday permitting Border Patrol agents to resume destroying concertina wire barriers placed along the Rio Grande riverbank. 

The justices, by a 5-4 vote, granted the emergency appeal from the Biden administration which, according to the Patriot Post, argued “that Texas was — get this — preventing the Border Patrol from doing its duty. That duty, last we checked, was to keep illegals from entering the country.” 

“The Supreme Court’s temporary order allows Biden to continue his illegal effort to aid the foreign invasion of America,” Attorney General Paxton said in a press release on Monday. “The destruction of Texas’s border barriers will not help enforce the law or keep American citizens safe. This fight is not over, and I look forward to defending our state’s sovereignty.” 

Texas had placed the razor-wire fencing along the riverbank as part Governor Greg Abbott’s Operation Lone Star to offset President Biden’s “reckless open border policies” that created the ongoing border crisis, allowing record numbers of illegal immigrants and deadly drugs to pour into the nation. 

According to Epoch Times, the Biden administration argued before the high court:  

“Like other law-enforcement officers, Border Patrol agents operating under difficult circumstances at the border must make context-dependent, sometimes split-second decisions about how to enforce federal immigration laws while maintaining public safety,” Solicitor General Elizabeth Prelogar wrote to the Supreme Court. “But the injunction prohibits agents from passing through or moving physical obstacles erected by the State that prevent access to the very border they are charged with...

IIRC, Texas was the only state that was a sovereign nation when it joined. It should have the right to freely LEAVE that which it has joined, IMO. The basic contract of entry has been completely violated.

So what are the Feds going to do to enforce the order? Nationalize the Texas Guard and order them take down what they put up?

If people follow the Constitution, the Biden administration cannot nationalize the Texas Guard. Only Congress can call up the state militias.

Article I Section 8 Clause 15:

To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions;
Even then, the President might command the militia, but its officers still belong to the state.

Article I Section 8 Clause 16:

To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress;
I'd love to see Biden try and Abbott refuse citing that only Congress can call up the Texas National Guard. Then, I'd like to see Abbott appoint the officers who refuse the comply with Biden's orders.

It’s only through mutual decision to respect Marbury v Madison that SCOTUS operates as the highest authority in the land. Democrats routinely ignore SCOTUS so why not Texas?

The threats wouldn’t surprise me. Them being taken as credible wouldn’t surprise me. Nor would the justices feeling that the government couldn’t protect them surprise me.

The Democrats would like nothing more than the right leaning justices on the court to be taken out by a cartel.

They took that into high gear on the day the FJB Regime's deadline fell back on the 18th. Brought in all sorts of steel barriers along with the pallets of wire. They're fortifying the crap out of that area.

Not arguing that.

But this was a move. The SCOTUS is converged. They were pressured for this.

So the fedgov is daring Texas to move, and the fedgov always doubles down. What will happen when they order the Infantry to open the border? Or they nationalize the Texas Guard?

Checks and balances - its in the Constitution - to keep the three branches of our government co-equal. It worked until the politicians let John Marshall get away with making the Court MORE equal than the other two in 1801.

The County Sheriffs are the highest elected officials of their county and can enforce the US Constitution as they see fit.

Article IV Section 4 :"The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion".

Also 10th Amendment states : "the federal government has only those powers delegated to it by the Constitution, and that all other powers not forbidden to the states by the Constitution are reserved to each state."

The US Constitution overrules all.

The Supremacy Clause states : "This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any thing in the Constitution or Laws of any State to the Contrary notwithstanding.

I believe a constitutionally legal interpretation by a Sheriff can overrule unconstitutional decisions and they have the juice to enforce their decisions.

Sheriffs need to go Buford Pusser on the unconstitutional corrupt feds.
