Supreme Court Justice Samuel Alito issued a stay order Tuesday blocking the decision of a federal appeals court that required the counting of undated ballots in Pennsylvania elections.
A lawsuit challenging a 2021 local election in Lehigh County, Pennsylvania, involved voters who submitted mail-in or absentee ballots without including the date. Pennsylvania law requires that the voter both sign and date his or her ballot.
The matter eventually ended up in federal court because one provision of federal voting-rights law, 52 U.S.C. § 10101, purports to limit what sort of information a state can require on a state ballot. A federal district judge ruled in favor of the state law.
The U.S. Court of Appeals for the Third Circuit reversed. A three-judge panel consisting of two Democrat-appointed judges and one Republican-appointed judge held that the relevant provision of state law violated federal law. The Philadelphia-based appeals court accordingly ordered the undated ballots be counted.
While a local election in the Keystone State may not typically be a topic of national news, this ruling also has significant implications for other races. There are hotly contested races for governor and U.S. senator in the state. Currently, the top two candidates for the Republican nomination in the U.S. Senate race, Mehmet Oz and David McCormick, are only a few hundred votes apart. And of course, Pennsylvania is a critical state these days in presidential elections as well.
Alito issued a stay blocking the Third Circuit’s decision. The matter is likely to be referred to the full Supreme Court now.
This stay is only temporary.

Say what you will about Ann Coulter, but she’s the reason we have Alito on the Court. G W Moron had such abysmal approval ratings that he was forced to keep what little base he still had by withdrawing Miers and appointing Alito instead.

How does one know voters submitted them in every case? Shouldn't one just say ballots without a date and not blindly assume the person named was the one submitting it? After all wouldn't the point of being suspicious of an undated ballot be that it may have been put in late after some bad actor discovered who had not already submitted a ballot?
The directions for filling out the ballot is very specific. It says "sign and date the outside envelope...if you do not...Your vote will not be counted."
You can't get clearer than that.
If after that court case, they felt the date was irrelevant, they would NOT have put it on these election ballots....with the above noted statement".
PA has a June 8 deadline for the primary to be decided, so unless the SC lifts this stay in one week, Oz will almost certainly be the candidate.
In all fairness, the fed has a limited amount of power over elections, per that pesky constitution thingy....
The reason this last election was stolen, is because at the state level there are far too many bush league chamber of commerce worshiping republiCAN’Ts.

The Constitution says that only state legislatures can change election law and many state Governors and Attorney Generals changed them. It should have been heard but they were terrified of the Communists.

And Barrett recused since she was just appointed by Trump. Normally Barrett would be right there with Thomas and Alito. So that makes 3 or 9 that will want to hear the case. 2 more and the SC takes the case.
Not really - those previous cases were in Pennsylvania state court. This case is in Federal Court.
