Trump sues Hillary Clinton, DNC over Russian collusion allegations

Former President Trump is suing Hillary Clinton, the Democratic National Committee (DNC), White House national security adviser Jake Sullivan and several others over allegations that his 2016 campaign colluded with Russia.

“The actions taken in furtherance of their scheme — falsifying evidence, deceiving law enforcement, and exploiting access to highly-sensitive data sources — are so outrageous, subversive and incendiary that even the events of Watergate pale in comparison,” a complaint filed Thursday said.

The lawsuit left open the possibility of adding more defendants later as facts evolve. The defendants in the charging document all had a hand in fabricating fake charges and pushing it to the FBI and pushing it out to the media.

Section 1961(1) of RICO also provides that “racketeering activity” includes any act indictable under 18 U.S.C. 1832 (relating to theft of trade secrets) and 18 U.S.C. 1503 and/or 1512 (obstruction of justice). As set forth herein, in furtherance of the scheme to defraud the Plaintiff, the RICO Defendants engaged in numerous acts in violation of 18 U.S.C. 1832 and 18 U.S.C. 1503 and/or 1512, including, without limitation, as set forth herein.

Count III Injurious Falsehood (18 U.S.C. 2701-12) (Against Clinton, Sullivan, Schultz, Danchenko, Sussmann, and Steele)

Count IV Conspiracy to Commit Injurious Falsehood

Count V Malicious Prosecution

Count VI Conspiracy to Commit Malicious Prosecution

Count VII Computer Fraud and Abuse Act (18 U.S.C. 1030)

A few more.

Lays out a couple hundred factual allegations, many with citation to supporting evidence. Demands a trial by jury. All defendants will move to dismiss (it would be malpractice to not do so), and odds are the case will be tossed by the courts. This is too big to expose, and too wrong to set right. Courts will not render a legal conclusion that favors Trump, even if he is in the right. Banana Republic does not roll that way.

Technically, tor triple that. He is claiming actual damages around 24 million. RICO allows recovery of treble damages.

I agree about the motion practice which will also assert some or all claims are barred by the Statute(s)of Limitations. The legal battle should be epic.

IIRC, default federal SOL is five years. Rico is four, but see rico.uslegal.com/rico-and-statute-of-limitation/ for caveats.

I figure there are other grounds, for example anything based on obstruction of justice is barred to civil complainants. Obstruction being solely under the province of the government sort of argument.
