and Biden v. Missouri (Healthcare mandate)

Doing it in a twisted way, making someone else mandate it, still effects your individual liberty.

I deal with OSHA mandates all the time. Show up on a construction site without a hard hat in my industry and you'll deal with both OSHA and the contractor's insurance carrier.

Let's all be honest here. It's the nature of this OSHA mandate that's really made it unacceptable, not the legality of OSHA mandates.

I'm surprised nobody has raised the most obvious point here in this legal proceeding: Using an OSHA Emergency Temporary Standard to impose permanent conditions on workers is an outrageous abuse of ANY government power.

No one seems to be discussing the dangers or risks of the vaccine itself, the fact that the vaccine is completely ineffective or the constitutionality of mandating medical treatment. It’s all about protecting society.

I had to stop listening. Nobody has mentioned the health risks of listening to idiots who have the power to destroy your liberty. My blood pressure is through the roof.

Kavanaugh’s questions seem to be focused on the major question doctrine. That doctrine holds that we DON’T defer to agency statutory interpretations that concern questions of “vast economic or political significance.

He is very hard to read. His questions can be read either way.

I’m more confident about Barrett than I am about him.

If this holds then OSHA should be able to mandate firing everyone who is overweight and deny them UIB. Then we will hear the howling! Most Demonrat women are 5’2” tall and that wide as well.

“They are not arguing if it is CONSTITUTIONAL!”

Has anyone cited the Commerce Clause yet when questioning OSHA’s authority? Perhaps that issue was raised in the lower courts.

The guy arguing against the federal mandate actually argued that Ohio could validly institute the same regulations. That it is a State issue. If that’s true, then the commerce clause would allow the feds to do it.

He surrendered the constitutional argument. We’re doomed.

That is already a thing.

I worked at a company ten years ago that was trying to implement a BMI requirement. They stopped because the Union was going to strike, but the requirement was viewed as legal.

The insurance companies were pushing for it.

Same with weekly (yes, weekly) tests for nicotine that they floated for a while.

I can’t listen to it anymore. OSHA can make grandiose and unscientific statements and basically will steamroll over this proceeding.

Kagan’s long argument about “low risk doesn’t mean no risk” was just criticized by council[Flowers}as being “irrational”. It’s rare to have an attorney in this room bite back like that!

According to Twitter, Flowers is triple vaxxed and arguing remotely due to testing positive for Covid.
