Democrats Intro Bill To Strip Federal Grants From Employers Conducting Criminal Background Checks

House Democrats introduced a bill to block forms of federal grants from going to employers that conduct criminal background checks, or even “inquire” about the criminal history of an applicant.

The bill, introduced by Representatives David Trone and Maxine Waters, seeks to “amend” the Omnibus Crime Control and Safe Streets Act of 1968 by “conditioning eligibility for grants” under the Edward Byrne Memorial Justice Assistance Grant (JAG) Program.

JAG grants, according to the Department of Justice, compose the “leading source of federal justice funding to state and local jurisdictions.” The program “provides states, tribes, and local governments with critical funding necessary to support a range of program areas” including crime victim and witness initiatives, mental health programs, and crime prevention.

The bill would amend the program by introducing an “eligibility” clause for private employers, excluding grant recipients from requiring applicants to disclose their criminal records. What’s more, businesses aren’t even allowed to “‘inquire” about the matter with applicants or “conduct a criminal background check”:

‘‘ELIGIBILITY.—Beginning with the third fiscal year that begins after the date of the enactment of the Workforce Justice Act of 2021, to be eligible for an allocation under this section, a State shall have enacted and be implementing legislation that prohibits private employers from—

‘‘(A) requiring an applicant to disclose whether the applicant has a criminal record;

‘‘(B) inquiring about the criminal record of an applicant prior to a conditional offer of employment; and

‘‘(C) conducting a criminal background check on an applicant prior to a conditional offer of employment.’’

No background checks would explain the crooks working at the State Department, FBI, CIA, IRS, EPA, etc...

This is nuts. Even California allows employers to run criminal background checks on prospective employees - and it’s required for some jobs. My daughter had to have her fingerprints run for a nursery school teaching job and my husband had to have his run for a college teaching job. For certain positions, employers are allowed to run credit checks.

I hope this bill has a provision to ban lawsuits agains employers when their employees commit crimes against other employees or customers.

I’m a volunteer for a county emergency management agency. They get federal funds. Every volunteer has to go through a background check. SOP.

An amusing anecdote: I worked on a program doing mission planning systems for a UK military branch. The code included very detailed aircraft performance calculations to get the mission planning spot on. It's software used in programs like "Top Gun". We had an applicant for a position writing software for the program who was a habitual marijuana smoker. Really? Software that could splash a $20 million jet fighter authored by a chronic marijuana user? Nope. Not happening.

When you apply for a Federal Government job you have to disclose any criminal history and if the job has any kind of clearance involved, they will investigate the truthfulness of your answers. I tell anyone applying for such jobs, to be up front and honest about any problems in your past because if they catch you lying, you are toast. Of course that advice does not pertain to politicians or political appointees who basically can lie through their teeth and just amend their remarks later.

Investigations will still be required for any contractor employee needing a security clearance to perform their job. No stupid law passed by these nitwits is going to change that.

I own an apartment complex. My great state is wanting to pass a law I will no longer be allowed to do criminal background or credit checks on prospective tennents.

Yup...I've worked for the US Government twice. Once,in 1969,I joined (with encouragement from my draft board) the US Army. And for about 5 months last year and early this year I worked for the US Census Bureau. And I'll be working for the Census Bureau again starting in June.

The application process...mainly the background check...is exhausting.
