While the responses are dead on accurate, there appears to be the assumption that the Democrats are doing any of this fairly.

grounds for an appeal using the bill of attainder clause.

It is a well written response, however, it appears there is no place to take an appeal regarding an alleged bill of attainder. In Belknap, the Senate found jurisdiction after the individual had left office. In Trump, the Senate again found it constitutional to proceed with a trial after Trump had left office. The courts do not sit in review of impeachment convictions in the Senate.

Something could be attempted in court, but how does one overcome Nixon, 506 U.S. 224, 234, 235 (1993)? (234) “There are two additional reasons why the Judiciary, and the Supreme Court in particular, were not chosen to have any role in impeachments.” (235) “Judicial involvement in impeachment proceedings, even if only for purposes of judicial review, is counterintuitive because it would eviscerate the ‘important constitutional check’ placed on the Judiciary by the Framers.”

(IEEPA), the National Emergencies Act (50 U.S.C. 1601 et seq.) (NEA), section 212(f) of the Immigration and Nationality Act of 1952 (8 U.S.C. 1182(f)), and section 301 of title 3, United States Code,

I, DONALD J. TRUMP, President of the United States of America, find that the ability of persons located, in whole or in substantial part, outside the United States to interfere in or undermine public confidence in United States elections, including through the unauthorized accessing of election and campaign infrastructure or the covert distribution of propaganda and disinformation, constitutes an unusual and extraordinary threat to the national security and foreign policy of the United States.

Basically what this Executive Order says is that anyone involved in interfering in the 2020 election or supporting of the fraudulent elections either foreign or domestic, their property and assets will be frozen.

This includes, main stream media, social media, and anyone else who was involved in helping to steal this election.......................part of the EO..please read it again all the way through. Congress nd the Media is ALL show!

Nothing about voter fraud but it does state that the Pres was being denied his First Amendment rights by being punished for free speech - especially political speech.

I do hope that in some way - Either in this Senate trial or before SCOTUS - Trump can bring forth all the proofs he has regarding the clear cases of election fraud.

I do not believe the impeachment can go to the Supreme Court due to the separation of powers. The Supreme Court judges legislation, not the rights of Congress. Impeachment is a constitutional right of the Congress to which the Supreme Court has no jurisdiction. Only the Senate can say to the House, their impeachment is out of bounds and the Senate refused to do so when the vote on that question was put forward by Senator Paul.

I am going to qualify your statement. It is a bona-fide, actual, genuine Constitutional Crisis, not some cheap CNN-declaration imitation.

If the Senate and House totally flout the Constitution in an area where SCOTUS supposedly has "no say" the what is the recourse? We have been told infinitum that SCOTUS is there to interpret the Constitution.

Why would SCOTUS, interpreting and insisting that impeachment is for current office holders only and that the Chief Justice must preside of impeachment of a president, be infringing on the Congress' pure power of impeachment? SCOTUS is only insisting that Congress follow the Constitution as written.

This makes no sense because if a private citizen, who once held office and finished their term, is going to be impeached and Congress has absolute power over impeachment then SCOTUS cannot call it a Bill of Attainder because then they would be making a judgement over the impeachment process.

That is not correct. If Congress makes a law that people cannot say the word "Trump" or they will go to jail, SCOTUS would rightly state (let's hope!) that this is contrary to the First Amendment and Congress "shall make no law..."

If Congress's power of impeachment is absolute then they can call every bill an article of impeachment and then the SCOTUS could not shoot it down or even get involved.

Focuses on the unconstitutionality of state judges and administrators changing voting rules, which are specifically and uniquely delegated to state legislatures only.

PA, MI, WI, GA, etc. mooted their own voters votes accordingly.
