CMS was worried enough early on to relax rules so nursing homes could refuse to take back positive residents if need be.

Cuomo was worried enough about the fallout that nursing homes were protected from civil and criminal liability in the new budget back in early April.

My bet is that protection and/or threats from the state are why nursing homes took the patients back instead of refusing.

If anyone is serious about investigating, they might to take a good look at what’s happened in Steuben County in Upstate, NY. The way the outbreak there was handled might provide some clues.
