Judge Emmet Sullivan had two choices: He could ignore the growing evidence of government misconduct and wind up the two-year saga that has been the sentencing phase of the Michael Flynn criminal case, or he could say not on my watch. Yesterday, in a methodical and seemingly tempered opinion, the long-time federal judge opted for the former tack when he denied in full the comprehensive motion to compel Flynns attorney Sidney Powell filed several months ago. Judge Sullivan then set Flynns sentencing for January 28, 2020.
While Judge Sullivans opinion appeared measured as he dispatched the myriad issues Powell raised on behalf of her client, two passages, separated by scores of pages in the tedious 99-page opinion, make clear that the outcome was a forgone conclusion.
The Court notes that Mr. Flynns brief in support of his first Brady motion lifted verbatim portions from a source without attribution, Judge Sullivan began his analysis of Powells legal arguments under a bolded heading entitled Ethical Concerns with Mr. Flynns Brief. Judge Sullivan then notes that Powells brief provided a hyperlink to the excellent briefing by Amicus in support of the Petition for Writ of Certiorari in Brown v. United States.

This half-assed excuse for a judge is more concerned with Powell's use of an unattributed statement than gross misconduct by the FBI and DOJ in framing Mike Flynn? God save us from these evil bastards!

Now is the perfect time to pardon General Flynn and be done with this farce. It would have no political effect for the 2020 elections at this point.
The general was clearly set-up and prosecuted on a trumped up charge in a frightening abuse of state powers. Given the choice of fighting the Feds in a trial until forced into bankruptcy or a guilty plea, Flynn took the plea. How many of us would have the means to fight the Feds?
Spun the right way, the pardon would be President Trump taking on the Swamp. And it is the right thing to do.

Although he is sure to receive a pardon, Flynn would prefer to have the charges vacated. That would leave him a clean record and I think reinstate his pension.

Are you confusing Judge Sullivan with Lawyer Powell?
He didn't and won't loose his pension. He is probably pulling in somewhere near $150K a year.

Flynn really hurt himself by pursuing conflicting and incoherent legal strategies over the last 2+ years. Every point that Powell raised here should have been part of an actual trial in the case, or in pre-trial discovery. By pleading guilty and making sworn statements admitting his guilt multiple times in front of THIS judge, he undermined his own case here.
One Freeper likened this to a football game where a team is facing a fourth down situation close to the goal line. They decide to run a play to attempt to score a touchdown ... and then after that fails, they complain to the referee that they should be given a chance to kick the field goal instead.
Are we sure Sydney Powell is not deep state?
It appears quite likely Flynn’s original lawyers were compromised by the FBI and conspired with the FBI against Flynn.
I see a pardon in Flynn’s future. He made mistakes but does not deserve this treatment.
Anyone who lets his own legal team act against his interests has no business even signing a car loan or a personal check. This guy is supposed to be a national security expert?
Sullivan proved that judges are employees of the Deep State.
