Elections have consequences for the Supreme Court ---If a seat opens up, Trump must fill it---
The Boston Herald ^ | 08-27-2019 | Herald Staff

If a seat on the United States Supreme Court opens up, President Trump must nominate a judge and the GOP-majority Senate must, if the nominee is qualified, confirm him or her.

Undoubtedly, there will be a loud and raucous chorus of voices decrying such a maneuver and we are already hearing warnings of monumental chaos if the president and the Senate majority leader were to move forward.

As the Herald’s Rick Sobey and Sean Philip Cotter reported, political prognosticators fear the worst.

“Both sides would be fighting it out as if it’s Armageddon,” pollster John Zogby said Sunday. “Democrats would be saying, ‘This is the end of the world and the end of America as we know it.’ It would be a battle royal.”

Is there a “statute of limitations” on the liberal anger over the Merrick Garland situation?

I would be ok with following the so-called “unwritten rule” of not nominating during an election year.

Let’s go ahead and make this next election about SCOTUS. We seem to do well when that’s an issue.

RBG doesn’t even have to show up until October....

The Court’s start date is mandated by a law passed by Congress. In 1916, Congress moved the Court term’s start date from the second Monday in October to the current one, the FIRST Monday in October.

If RBG DOESN’T show up, declare the seat vacant, then watch the liberal heads explode.

The detonation will be felt on the Moon.

How can this be the end of America as we have known it, if the SCOTUS justices each adhere to the Founding Documents in their rulings?

They only way for this nation to become something different, would be if the Founding Documents were ignored, and anti-Constitutional laws became the law of the land.

The Left is so screwed up in the head.

That is very true; but, those same Americans might want to remember the old saying. “Be Careful what you wish for. You just might get it.”

Those same people do not realize that their side could just as easily turn on them somewhere down the road.

The difference is that Trump will have a chance at a second term, while Obama was a lame duck. So, the view was that the new President should have the right to nominate the SC judge, not a lame duck one. If a seat is open, Trump will fill the seat.

Their side WILL turn on them.

Only the select few will be at the top living well.

The loyal and brainwashed army will put down the rest.

The so-called Biden Rule was made up in 1992. When Bush had a chance for a second term.

If a seat is open, Trump will fill the seat.

Yes he will. But let's not pretend it's due to the fact he's in his first term. The Biden Rule has no basis in the Constitution. McConnell blocked Garland because he could. He'll try and push through a Trump nominee next year because he can. Whether or not there are 50 vote to confirm is the unknown.

If it were purely a Constitutional question, nobody would care. But this will be a fight over ideology...............

The ideological fight makes it the most purely Constitutional question of all: Does the Constitution mean anything?

We already know that the President said Amy Barrett would be nominated to replace Ginsberg.

Don't worry, Susan Collins and Lisa Murkowski will be there to block her nomination, claiming something like "we can't be sure she'll protect reproductive rights" or some other crap

Probably Mitt Romney too ... you know, the usual un-dependables

Exactly what has been going on for at least 85 years.

Yes, it has been 85 years of Progressive dominance on the Supreme Court.

Most of these ‘rules’ have no basis in the Constitution. I guess the Democrats controlled the Senate in 1992 and just said they were going to wait to see who won the Presidency? I thought that McConnell justified his actions because of the issue of Obama being a lame duck and that the new President should decide on the SC judge.

(speaking of the Constitution, I assume.)

You are exactly correct. It is a major part of the Progressive philosophy. The desire, the need, to ignore the Constitution as written, is part of Leftists, particularly, Progressives' DNA.

That appears to be coming to an end.

Trump has five years to make two or three more appointments.

Love it.

It’s my understanding that pancreatic cancer is basically a death sentence. I wouldn’t be surprised if she lasts only a month or two.

All hell is going to break loose.

Trump should be nominating someone today.
Our representatives should be urging RBG to retire.

We have no representation.

Yeah, thanks.

Of course the Left will try to pack the court as soon as they can, adding more judges to swing it back to LoonyVille..
