The Supreme Court on Monday found that a criminal defendant can be sentenced for violating his supervised release, even if the release expires while he is incarcerated ahead of facing new charges.
The justices, divided in the 5-4 decision, ruled against Jason Mont's argument that a district court shouldn't be able to charge him for violating his release because the term had expired at the time of the new sentencing.
Justice Ruth Bader Ginsburg sided with conservative Justices Clarence Thomas, John Roberts, Samuel Alito and Brett Kavanaugh in the majority. Justice Neil Gorsuch joined liberal Justices Sonia Sotomayor, Stephen Breyer and Elena Kagan in opposing the decision.

Wait a second...the guy was never released from prison and because he was never released he failed his ‘supervised release’ and that got him four more years in prison???

Her clerks asked Justice Ginsburg to blink once if she was voting with the Chief Justice and to blink twice if she was voting against the CJ.
She blinked once. The clerks rushed out of the room to cast her vote.
Five minutes later she blinked again. But no one was there to see it.

The bigger news to me is that Gorsuch was over on the left again. Is it blackmail, or was he a closet lefty all along himself and/or is he looking to become the new swing vote once Trump replaces RBG?

I dont really trust Gorsuch. He is an active member of a radical leftist church with a female pastor who despises Trump. She was at the feminazi rally led by Madonna and the rest of the coven in DC the day after the inauguration.

I think it’s like this: He was released on parole. He violated that parole. Awaiting trial for parole violation charges, his parole period expired. He argues that they should not be able to charge him for parole violations once his parole period ended.
What seems confusing is that it takes a new charge, a new trial and a conviction in order to add time to the original sentence for a parole violation. Maybe there is some sense in that, but I would think that the easy solution is if you violate parole you go back inside the remainder of your sentence.
If you commit a new crime while on parole that should be a new trial, new sentence plus revocation of parole. But a whole new trial just for a parole violation? Should just be an administrative decision. The convict is still technically a prisoner.
His vote worries me, too.
It's the second time in a month that he voted with the Leftist judges (minus Ginsburg this time).

I would not worry about Gorsuch. The issue in the case dealt with statutory construction. This is not a conservative or liberal issue.
Tell the dumb people who think she’s dead.
She was programmed to find out how Gorsuch was voting and to vote the opposite way.
