A federal judge in New York ruled Tuesday that the government must fully restart the Obama-era DACA deportation amnesty and accept brand new applicants as well as renewals, throwing a potential wrench in the ongoing debate over the fate of Dreamers on Capitol Hill.
Judge Nicholas G. Garaufis said the administration does have the power to revoke DACA, but it must give a sound reason for doing so and the Homeland Security Departments September 2017 rationale fell far short of what is required in that regard.
He becomes the second judge to rule President Trumps aides bungled the phaseout but his decision is the most wide-ranging, ordering the government to not only allow those already in the program to renew their applications but also ordering the government to accept new applications.

where in the constitution does it say you need a good reason to revoke an executive order.
Executive needs to tell judicial, NO.
Make me. Oh, and your funding is gone.
Agreed on both counts.
“Nuremberg style treason trials and hangings on the national mall is the only way America can survive.”
Looks like we’re headed that way.
This is ludicrous. A President can end an order whenever they want without a reason. I just checked - appointed by Bill Clinton.
Based on what law?
Judge Nicholas G. Garaufis has made his decision, now let him enforce it.
If the Supreme Court overturns your Judgement, you will be tossed out as a Judge!
President Trump should ignore this idiot.
Should tell this “judge” you ordered it, you enforce it then.
Has been done before in history.
Every time Dimorats lose on an issue, they run to the lefty court to stop it anyway. This has to stop.
I couldn’t agree more.
I wonder how many retirements it would take?
Make it three strikes, and make one strike optionally possible from a "Federal Judicial Review Board" populated by an independent panel; ie, make all Federal Judges open to the same irrepressible government 'suasion' as this Judge sees fit to impose upon US, as US citizens...
Three strikes resolves to absolve one error by mistake of fact (versus law, or interpretation), and yet an FJRB - which surely will eventually impose its mark on every judge, Left or Right - would create a scenario whereby you screw up twice on the same personal bias (like overruling an EO that legally countermanded a previous EO), and you're retired on the spot.
The court and what army?
So and Executive Order can start it but an Executive Order cannot stop it.
What the fudge? Tell the Judge to enforce his “demand”.
Created by a president’s (Obama) Unconstitutional proclamation.
Rescinded by the present President.
That’s how it works.
Trump stopped an unconstitutional act by Obama.
Courts have no jurisdiction in this matter.
Trump needs to ignore all this “legislation” by judges.
Do you have the exact quote from the Constitution from which you got your statement?
Your ALL CAPS post is not from the wording of the Constitution about this matter
Might be because of who he has to hang with on our Supreme Court....
@#$%^&*!
WHY doesn’t PDJT write an EO to negate DACA? 0bama wrote one to implement it in the FIRST place!
PLEASE! Just be saving this for a Cherry on Top when needed! PLEASE! Otherwise, let’s just get ON with it!
I made the MISTAKE of watching the network news, tonight. I wanted to hear about the Westminster Dog Show, and that out-of-control BMW that spent 40 miles on a highway going 100 MPH before they pretty much blew out the tires, LOL!
But FIRST, I had to sit through EIGHTEEN (Yes, I counted!) minutes of Trump Bashing.
Man, I hate those mofos! Just HATE them!
Well, if the Trump administration insists on submitting to every Federal judge who wants to rule, it will only encourage more of the same.
Government lawyers. I am convinced that the lawyers at the DOJ are absolutely incompetent. I have never had such a losing streak as these aholes have had—regardless of whatever bias the courts have. I guess we get what we pay for.
