Cuomo says New York will sue over GOP tax law

Gov. Andrew M. Cuomo (D-N.Y.) said Wednesday that New York state will sue the federal government over the new Republican tax law, but legal experts are skeptical the lawsuit will hold up in court.

Cuomo said New York will challenge a provision of the law that limits how much Americans can deduct from their federal taxes for payments made to state and local governments. Many of the people most affected by that provision live in states run by Democrats, which tend to have higher state and local tax rates.

Cuomo, widely seen as a potential contender for the Democratic presidential nomination in 2020, said the provision is “violative of states' rights and the principle of equal protection.”

The entire tax code is built on the targeting different classes of people and favoring other classes of people. There are literally thousands of examples.

Democrats: Raising SALT because they know people just take it off their federal taxes, screwing the rest of us as we pay that subsidy for their local taxes.

Heck, at least three SCOTUS are a lock for Cuomo, and Benedict Roberts would most likely throw in with the "living breathing Constitution" types as well ...

The 16th Amendment says:

The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.

The 16th Amendment makes the States irrelevant regarding the Congress's power to tax income. The Supreme Court said differently in Pollock v. Farmers' Loan & Trust Company, 157 U.S. 429 (1895), but the 16th Amendment overruled that decision. Cuomo apparently knows of Pollock, but not of the 16th Amendment. That's strange for a Liberal, because the 16th Amendment is one of their favorite amendments.

Freedom doesn’t actually mean anything to these people. They want to solve everything in the courts such that nothing is left to the will of the people.

Haha. The states being subsidized by the low tax states for decades are now going to pay their fair share and those high tax states are going to be forced to lower taxes for their citizens.

Guess that means any NY business can sue the state for giving "tax incentives" to lure businesses to the state.

They don’t rebel. They bug. I’m amazed the state legislature hasn’t enacted an “exit tax” yet. The rumor’s been floating around for a while now.

IS this the onion? Think the US Constitution is pretty clear on taxation and who is resposibsile. I am sure Cuomo will judge shop and find a friendly #44 appointment.
