In a political environment as volatile as this, his power as the Courts swing vote is at its maximum. It seems counter intuitive that he would retire as his influence reaches its apex. Whats more, Kennedy has a high opinion of the Courts capacity to bear moral clarity for a restless nation, making his continued service a matter of duty.
However true this may be, the justice is 81 and he is, after all, a Republican. Given his age and political inclinations, it is reasonable to assume he would like to retire and would prefer to do so under a Republican president. Jones stunning victory Tuesday betrayed the vulnerability of the GOPs Senate majority, and the very real possibility that Democrats will seize control of the upper chamber in November 2018.

Republicans are past masters at snatching defeat FRom the jaws of victory - witness Alabama!
From now on every Republican in every race should find a woman to accuse the Dem of sexual misconduct first.
Heller should not be re-elected, he has already voted for amnesty once.
They don't have to work much, anyhow. Just show up in their offices when they feel like it to fiddle around shuffling papers.....or to totter to their seats on the banc when the Court is sitting.
Their law clerks, aides and well-paid flunkies do all the office tasks, all the complicated legal research and, undoubtedly, most of the final required, tedious, difficult writing of lines of questioning, opinions and decisions.
Why SHOULD these pampered old croaks retire at home with their cushy pensions....life is one cushion after another for them in their Courthouse itself.
Retired at home, they'd have to put on their own (bath)robes every morning and watch CNN all day.

Kennedy better get it done by 2019 or the lame-duck rule will go into effect.
True. I would be happy with 5 additional Senate seats.
True - with only 51 votes in the Senate...at best you will just Kennedy with a younger version of the same.
“Let me predict right now that there will not be another originalist approved to the Supreme Court period.”
Why not? Three Democrats from red states voted for Gorsuch, plus Pence’s vote is there if needed.
Because both parties hide behind a divided court. They use them to impose things on the public without taking blame, ObamaCare being the most recent case. They hav used the court to effectively amend the Constitution which they could not do otherwise. They may announce a real Judge but they will not approve one, just my opinion but based on my years of observation. Bare in mind some of the worst ever were appointed by Republicans.
Kennedy hired one clerk for 2018. Retired SCOTUS justices are allowed one govt-paid clerk.
You know, I had that thought too.
LOL
Yes, that would make heads explode!
Thought I had responded to this, but that would be great, and good solid reasoning there. Thanks.
They thought that in 1932 also.
Just posting more details. The statement “Kennedy is considering retirement” may need supporting facts. And the clerk question is a little tricky.
I had heard that he was.
They thought what?
You thought right.
I do note though, that they have now stated they will reject two of his nominations stating they have been associated with racists, or some such.
Of course they think we’re racists too, since we wish to see illegals sent home.
With a one point less margin, I sure hope this next year doesn’t go South on us.
I think the GOPe is as fearful of a Right leaning court as the Leftist are. They know darn well the court would side with the Conservative position almost always.
They sure don’t want any part of that.
You could be saying this about Congress-persons also - more or less.
We've been away at a resort near Disney for a week... a lot of catching up today.
I told my son that now that the Democ🐀s have won this race they will go bonkers to finish off Prez Trump any way possible - with the help of their immense yellow journalism helpers. Plus: Meuller is finding himself in deepening waters... time may be running short for him to complete his mission. This invasion of transition team emails is going to raise the stakes a bunch.
Still, sometimes I fancy the LORD is interfering for the good side. 😉
