Chief Justice Appears To Take Shot Across Gorsuch’s Bow

In remarks given at a judicial conference in Pennsylvania this week, Roberts reiterated his long-held view that the Court should speak with one voice wherever possible — that is to say, he supports a consensus-driven approach to opinion writing in which the justices strive for unanimity and avoid writing their own concurrences or dissents. In doing so, he appeared to rebuke Gorsuch, who has flashed a propensity for writing on his own in his first months as a justice.

Roberts never mentioned Gorsuch by name and there are entire dockets of cases in which the Usual Suspects From The Left disagreed with Roberts a lot more often over the years.

Sure - he’d prefer a bunch of 9-0 decisions, but that’s seldom going to happen.

TELL IS AGAIN HOW THE OBAMACARE PENALTY IS ACTUALLY A TAX YOU SON OF A TURNIP.

And tell us where the Constitution allows the Federal Government to collect taxes on individuals other than income taxes? (Obamacare is NOT an income tax)

Article I, Section 9, Clause 4: No Capitation, or other direct, Tax shall be laid, unless in proportion to the Census or Enumeration herein before directed to be taken.

16th Amendment: The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.

I wonder if Roberts shouldn’t be cutting Gorsuch some slack. The guy was confirmed a short while ago and has had to make a herculean effort just to get caught up with this year’s court cases. He’s barely had a chance to get to know his colleagues, so it’s not surprising he’s writing his own opinions rather than sitting back and letting Chief Justice Roberts perform his ventriloquist-act.

In two more years his children will both be adults. If the circumstances of their adoption is what is being held over his head, it won’t matter then if it even matters now.

Supreme Court justices seem to have been a fifty-fifty proposition for the Bushes. For every Thomas or Alito they nominate a Roberts or Sutter. I’ll also remind you that Reagan was responsible for Justice Kennedy.

Scientific "consensus" brought us the global warming hoax. Why should we bow to judicial "consensus?"

A legal decision is either right or wrong as judged by the constitution. If consensus ruled, a lot more decisions should be 9-0, rather than 5-4, because the differences would have been ironed out before the justices "voted". Our modern supreme court is about politics, not the law.

I mean, does a concurring opinion carry any weight that a majority opinion does not carry? Is this just an ego thing, or are there actual legal ramifications?

A related question would be - if the concurring justice fails to agree to the majority opinion in toto, are there legal ramifications?

I’m thinking possibly yes - not sure though.
