I think that the Ex Post Facto concept does not apply to Civil Suits. So if the Michigan Legislature makes it a Civil Matter they could legally try to grab her money-a fitting and proper act with that Stein trash.

The statutory fee to Stein is $125 per precinct, to be refunded if the recount results in her winning the election.
The new statutory fee would be actual costs, which is greater than $125 per precinct, presumably also to be refunded if she won on the recount.

I wonder, though, if a retroactive law is itself legal. Is that the same as ex post facto? It shouldn't be legal, it really shouldn't, but there is precedence.
The Lautenberg Amendment retroactively took away anyone's Second Amendment rights if they had ever been convicted of misdemeanor domestic violence, no matter how long in the past the conviction occurred.
This caught a lot of military and law enforcement, since many plead guilty to misdemeanor domestic violence charges and paid a small fine rather than fight the charges in court and pay thousands, usually during a messy divorce.
The Lautenberg Amendment was upheld by SCOTUS.

IF the intention was to fund raise under false pretenses, sure, they should be confiscated. But if the intent was otherwise, even if to just throw confusion into the election and de-legitimize Trump, the contributors should be up sh*t creek.

The upcharge does not fall under 3d, because no punishment is involved. I'd still argue it is an ex post facto impostion of fees, and thta if the fees had been known in advance, I would not have started the process.
Courts work from the outcome backwards. There is enough precendent on both sides of the fence that it is trivial to choose the precedents that fit the selected outcome.
