The upcharge does not fall under 3d, because no punishment is involved. I'd still argue it is an ex post facto impostion of fees, and thta if the fees had been known in advance, I would not have started the process.

Courts work from the outcome backwards. There is enough precendent on both sides of the fence that it is trivial to choose the precedents that fit the selected outcome.

Thanks. Makes sense.

If the report about the new MI law asking full recovery from those greater than 5% from a victory is true, then that would truly discourage frivolous recounts such as Stein’s.

However, I always thought she was doing so at the behest of the Clinton campaign. So, in the future, the true aggrieved party would have to step up if they want a recount.
