Exclusive: FBI still does not have warrant to review new Abedin emails linked to Clinton probe

When FBI Director James Comey wrote his bombshell letter to Congress on Friday about newly discovered emails that were potentially “pertinent” to the investigation into Hillary Clinton’s private email server, agents had not been able to review any of the material, because the bureau had not yet gotten a search warrant to read them, three government officials who have been briefed on the probe told Yahoo News.

At the time Comey wrote the letter, “he had no idea what was in the content of the emails,” one of the officials said, referring to recently discovered emails that were found on the laptop of disgraced ex-Rep. Anthony Weiner, the estranged husband of top Clinton aide Huma Abedin. Weiner is under investigation for allegedly sending illicit text messages to a 15-year-old girl.

As of Saturday night, the FBI had still not gotten approval from the Justice Department for a warrant that would allow agency officials to read any of the newly discovered Abedin emails, and therefore are still in the dark about whether they include any classified material that the bureau has not already seen.

“We do not have a warrant,” a senior law enforcement official said. “Discussions are under way [between the FBI and the Justice Department] as to the best way to move forward.”

Huma "has no idea" how thousands of Clinton emails "found their way" onto the laptop of her estranged husband. A laptop which just so happened to fall into the possession of investigators not controlled by the US government.

Think this is all a coincidence?

I think if you start reading that document around page 19, as I recommended, you will discover that case law is somewhat different in different circuits, but the most expansive view is that the whole computer is a single container, and that is the case law in the Fifth Circuit, which has made the most rulings in this area.

But more importantly, depending on both the email client and its configuration, and the nature of their account access, it's conceivable that sender, recipient, date, and the first few header lines of every email on the laptop are all visible in a single pane, used to drill down to the full detail.

In such a case, literally thousands of emails would all have some of their most damaging information in plain view, intermixed between Huma's content and Weiner's. And there is no ambiguity in the case law about that. It's all admissible, even without a warrant.

Everything about the Clintons and Obama is curious.

I doubt the American people will ever be able to stitch together the entire picture of these criminals, but enough of their dirt is coming to light, that at least it's making them scramble like the cockroaches they are.

No, the problem is most people aren’t familiar with the court system. Comey doesn’t (and shouldn’t) know the content of the emails. Anyone who opened ANY of the emails with a Hillary or Huma header on it and read the contents may very well have jeopardized the criminal case.

Even if Weiner voluntarily surrendered the computer to the NYPD, he CANNOT give consent to the police to search anything other than HIS email. He cannot give consent for Huma or Hillary. Therefore the search warrant is needed.

I doubt if anyone who is a Hillary supporter will change their opinion or vote. They know what they are buying and just don’t care. They are awash in the Kool-Aid.

The independents may take another look, but it will take someone like Judge Napolitano or Judge Piro to explain the criminal rules of procedure for them to understand the process.

Hillary and the Dems are screaming foul knowing the noise may force her voters to vote early and then not be able to change their vote when the other shoe drops.

While Comey may have screwed up the original investigation, I would bet the agents handling this now are dotting every “I” and crossing every “t” to make sure there is no way she can slip out of this.

FWIW, I know people who worked in the White House when Clinton was there and she was universally hated by all the military and SS who were there. I also had the “pleasure” of working her detail when she was on the campaign trail the first time. I’ve heard many stories of thrown ashtrays, yelling, screaming, abusing those who she didn’t consider her inner circle.

I think this time will see a different outcome.

Its not that simple. The NYPD have the computer. The Hillery data was found while searching for material involving sexting charges against Weiner. As such the material may not require another search warrant from Comey, as it was uncovered in the process of a warranted search of Weiner’s device.

And if Comey needs a warrant for these e-mails, he will get it easily because the initial charge will likely be that Huma perjured herself.

No, Hillolita is finished. We knew that beause Huma was not on the campaign with her.

And all the Dem talking heads are throwing Huma under the bus. Mook is about to jump off a bridge.He is aiding and abetting a felon.
