COLUMBUS, Ohio A condemned Ohio killer who survived a 2009 botched execution is asking the U.S. Supreme Court to declare that a second attempt to put him to death would be unconstitutional.
Lawyers for death row inmate Romell Broom argue that giving the state prisons agency a second chance would amount to cruel and unusual punishment and double jeopardy.
A divided Ohio Supreme Court rejected Broom's arguments in March. Broom's attorneys appealed that ruling earlier this month to the U.S. Supreme Court and filed notice of that appeal on Monday with the state court.
The state stopped Broom's execution after two hours when executioners failed to find a usable vein following 18 attempts to insert needles.

Leave him alone with the relations of the victim and leave a variety if implements on a large counter/shelf/cabinet. Then walk out and give the relations at least four hours and the perp will be BEGGING for the conventional methods of the DP.

Double jeopardy is trying in a courtroom twice, not trying to execute twice. Nice try.
And he can’t prove “cruel and unusual” without demonstrating intent.
I think murder, the way a lot of these monsters murder, is cruel and unusual. The Wichita Massacre, that couple that was tortured and burned to death, then of course, Bundy and Gacy and Dahmer. I think Dahmer in particular was a monster the way he targeted minorities since he knew that the mainstream culture then was in fact indifferent to Asian minorities and the fact that they went missing was of no significant interest.
He was already officially punished for his crime. Just because the outcome of the punishment didn’t turn out the way the officials desired is irrelevant. Punishing him again IS double jeopardy.
Call them up! Cripes, if there ever was a chance to do some civic duty, this would be one of those times!
Yeah plugging him with a few of those bullets will solve that issue.

I could be OK with this. They had a shot and blew it.
How difficult is it to kill someone, let the guy’s victims in the door and turn your back.
It is not like he survived electrocution, the chemicals, a firing squad, hanging or whatever and had to actually go through one of those. They just couldn’t find a vein — hardly cruel and unusual punishment.
Nope, the punishment was death. It wasn’t done until it was done. If they couldn’t find a vein, they should have found a rifle or a rope.
If he was sentenced to go through the execution process once, and only once, he should be able to spend the rest of his days in a cell.
I can’t believe I am about to write this, but... If you can’t kill someone in the course of two hours, I’m sorry, you had your chance and blew it. I say commute the bastard’s sentence to life w/o parole and be done with it.
On a side note this is not the first time lethal injection has taken an unacceptable amount of time to gain the end result. It should be abolished and we should go back to hanging. Even when that is botched it doesn’t take more than ten minutes to kill someone by strangulation. And done correctly it is one of fastest and most humane forms of execution. The British had hanging down to a science. The whole thing typically took less than a minute from the time the hangman entered the condemned man’s cell to the moment the trap was released.
cruel and unusual punishment? the failure to find a vein is unusual, but unintentional. It’s not cruel, it’s not as if he were in prolonged agony and didn’t die, the execution was halted when needles could not be properly inserted.
double jeopardy? No, he’s not being tried again.
