Oregon standoff defendants' motions: Dismiss charges due to vagueness, government overreach

A ream of legal motions reveal some of the defense arguments in the pending federal conspiracy case against more than two dozen people indicted in the armed takeover of the Malheur National Wildlife Refuge.

Some of their lawyers are urging the court to dismiss specific counts of the indictment.

They argue that the conspiracy charge is "unconstitutionally vague" and that the charge of carrying a firearm in the course of a crime of violence won't hold up because the conspiracy didn't rise to a crime of violence, according to legal briefs filed Wednesday in U.S. District Court in Portland.......

Wow the govt has not even provided that info. This is exactly what they are charged with. Its like being in traffic court for speeding but the officer not giving the speed.......

Yea this is what the founders envisioned......

They burgled a then-shuttered establishment, but it was still a Fedguv responsibility to take care of that establishment. The logical answer to that would be a bureau.

This is like saying if you burgled my house and squatted while I was not there, this is not a crime against me.

At best it’s quibbling. OK, let the precise terminology be clarified in court, but the general outlines were of something wrong.

Look at the govt reaction when lefists occupy a federal building versus this response...
THIS IS GOVT ABUSE OF JUDICIAL POWER..... INTIMIDATION

the only law broken was THE MURDER OF LEVOY
and who actually did it..??
was it an FBI AGNET... probably
AND where are the results of the autopsy and was he armed or not?

These people stand accused of preventing a federal officer of carrying out his duties....a felony. I believe they have every right to ask the question, and recieve an answer of what officer and what duties.

Do you not?

Did they really expect not to have every legal precedent ever decided upon thrown at them in court?

The only option to that is 3 bullets in the back like we gave LaVoy Finicum.

Its all just governmental administrative 9 to 5 grind for all concerned now, cept for those few who get to go back to jail for the night.
