A New Jersey administrative law judge on Monday heard two challenges to GOP presidential candidate Ted Cruz's eligibility to appear on the New Jersey ballot, based upon the Texas senator's birthplace in Canada.
The judge, Jeff Masin, didn't decide the challenges to Cruz's eligibility to appear on the June 7 primary ballot, but said he would issue a decision Tuesday. The decision is expected to be reviewed by Lt. Gov. Kim Guadagno, who is New Jersey's secretary of state.
One of the challenges was brought by three South Jersey citizens, and the other by a law professor who lives in Maryland and is running for president as a write-in candidate in New Jersey. Both parties argued that because Cruz was born in Canada, he is not a natural-born citizen, making him ineligible for the presidency.
Cruz's mother was born in Delaware, while his father was born in Cuba. The senator released his birth certificate in 2013.
Shalom Stone, a New Jersey attorney representing Cruz, argued that the citizens - Fernando Powers of Blackwood, Donna Ward of Mantua, and Bruce Stom of Winslow Township - and Prof. Victor Williams didn't have standing to challenge Cruz's candidacy. Stone also said the state didn't have authority to decide the question.
As for "natural-born citizen," Stone said the words in the U.S. Constitution "have meaning given to them by English common law" at the time of their adoption. He directed Masin to his brief for cases supporting Cruz's position.

When George Romney ran in 1968, a legal opinion was sought and read into the Congressional Record. The opinion was, that Romney was NOT eligible, since he was born in Mexico, albeit to American citizen parents.
It dropped from interest when Romney quit the race fairly early.
That legal opinion conformed to what was the widely held interpretation of “natural born citizen” at the time.
In the case of Sen. Cruz, we are precisely one American citizen parent away from anybody on God’s spinning mudball, running for President.

Cruz absolutely is not a natural born citizen. I retired from the United States military and took many classes in Constitutional law and who are and who are not natural born citizens. The only persons born in a foreign land that are Natural Born Citizens are those born to United States citizens serving in the US State Dept or US Military. This does not include Cruz, as his father was a Cuban national, with Canadian citizenship, not working for the US State Dept and was not a member of the US Military. His mother had at one time been a US citizen, but in 1969 she voted in Canadian elections, so apparently she was also a citizen of Canada. Even though she apparently was born in Delaware, his mother also did not work in the US State Dept and she was not a member of the US military. Have you ever read where any historian has said Winston Churchill could have been US president, after all he was born in a foreign country to a US natural born citizen. Of course he was not eligible to be US president and Rafael Cruz is not eligible.
Rafael Edward Barack Hussein Obama Cruz is definitely not a Natural Born Citizen and is therefore not eligible to serve as US president.......or as US Senator, an office he now holds.

A naturalized citizen is a person who was born an alien, but has lawfully become a citizen of the United States under the U.S. Constitution and laws.
Probably not. But if the case is pending at SCOTUS , CRUZ will be advised to step Aside and wait till next time The damage it would do to the RNC is he is selected as candidate and then gets a not eligible ruling would be horrendous on top of all their other issues

Until both ‘THE PARTYs’ and the courts get this Constitutional law in their thick heads -the point is moot. Pray tell for naturalization tests, just what is the question to the new LEGAL immigrants when they arrive? What does it take to be a Natural Born Citizen? The left still hasn’t gotten the correct answer after centuries of double speak. What makes anyone believe the country would come to terms on what our FF actually had in mind when it was written. And those questions have yet to be answered satisfactorily by Teddy Bear Cruz. For won so loving our Constitution does he not see how he craps on this sacred document when coming out of his closet to run. This, if nothing else was why I should NEVER vote for this Canadian imposter. He is a liar and liars lie. If he lies about this; he lies about pretty near everything else as well. Just my 2 cents
WRONG. Cruz’ father did not become a naturalized U.S. citizen until 2005.

Cruz was a Canadian citizen for the fist 42 years of his life, only deciding to give up his Canadian citizenship when he decided to run for president. If he would unseal his records it would probably show he went to a college as foreign student. What in the hell is he hiding. That’s the question.

I’m a US Citizen, born here; 30y ago I was temporarily living in Canada and met a British girl living in Canada. We had a child whom we assumed was Canadian based on his Canadian birth. When we all moved back to the US when my son was 5, we applied for a green card for him which he still goes by. He feels that he’s a dual citizen, but Canadian first due to being born there. Could he trade in his green card and do nothing else and run for president of the US? It’s almost the same as what Cruz is doing.
Considering that Cruz likes to get way down in the muck to hustle Donald Trump out of delegates, I wouldn’t mind seeing a judge rule him ineligible for running. It would sort of be a comeuppance for him.
Canada did not recognize dual citizenship under the Canadian Citizenship Act of 1946, which covered Cruz. That changed sometime around 1977. The Canadian Citizenship Act of 1946 established their own nationality. Canadians were British subjects before 1946 as I understand it.

Correct. Suppose OBL, or Assad, or everyone’s favorite bad guy these days, Vlad Putin, came to the US and got a woman pregnant. Say that kid spent his summers in Russia, Syria, or Saudi Arabia and then turned 35 having resided 14 years in the US, then he too could run for President under Cruz logic! Or better yet, US citizen mom goes to some Middle Eastern hellhole with her “husband” who happens to be an ISIS terrorist and has a child. Years later, that kid comes back to the US with mommy, lives here 14 years while continuing to maintain contact with daddy’s insane relatives, gets elected to the Senate and then wants to run for President. Under Cruz logic, he could. This is not what the founders intended. But willful ignorance seems to be the order of the day.

I have a cousin like your son. He grew up in Canada, and has thus far, opted to be a Canadian citizen. His parents were American citizens, at the time of his birth in BC.
But none of that suggests “natural born citizenship.”
Actually, the PA case WAS decided on the merits:
"A Pennsylvania judge affirmed Sen. Ted Cruzs status as a natural born citizen Thursday and dismissed a lawsuit that sought to remove the candidate from the states Republican primary ballot, the Pittsburgh Post-Gazette reported."
The rest were tossed before they ever got to the point of arguing the merits.
So why haven't we seen the piece of paper that says that Cruz is a US citizen? I'd like to see the date on it.
