Antonin Scalia’s death should strengthen Ted Cruz’s case for the GOP nomination

The stunning death of Supreme Court Justice Antonin Scalia -- announced just hours before the six remaining Republican presidential candidates gathered Saturday in South Carolina for a debate -- immediately ups the ante in the GOP primary and could well cement the base's commitment to nominating a "true" conservative along the lines of Texas Sen. Ted Cruz.

"We ought to make the 2016 election a referendum on the Supreme Court," Cruz told NBC's Chuck Todd on "Meet the Press" Sunday. "I cannot wait to stand on that debate stage with Hillary Clinton or Bernie Sanders and talk about what the Supreme Court will look like depending on who wins."

As Cruz well knows, there is no issue that so animates the Republican base as appointments to the judicial bench -- most notably the Supreme Court. Many conservatives have never forgiven then-President George H.W. Bush for appointing David Souter to the court -- only to see Souter turn into a less-than-ideal conservative pick. George W. Bush's 2005 nomination of Harriet Miers was scuttled by conservatives who believed her past record demonstrated a lack of fealty to their principles....

Bush and Bush knew it then, but now any Republican president should never nominate anyone who is not in the mold of Scalia or Thomas.

The best case I can see resulting from this is Trump, being the presumptive nominee, cutting a deal with Cruz to give him Scalia’s spot, provided he keeps it open for himself by preventing Obama’s nominee from being confirmed.

Cruz recommeded Roberts who gave us Obamacare.

Just because your a good lawyer doesn’t mean you have common sense. Roberts is a disaster, especially since he is the Chief Justice.

Disagree....should strengthen Trump...to appoint Cruz the next USSC justice.

But we have to watch out....we are going to lose at least one repub senator...Rubio said he won't run.

Cruz probably can't vote for himself and/or will have to resign.

Much more than a justice at stake.

This is where we need a cogent and convincing Ted Cruz instead of an inarticulate and insulting trump.

Go stick your head under a rock and ignore the importance of this. I know as a Trump supporter you don’t want to discuss this because your emperor has no clothes and that will be revealed if you ask him to have any meaningful debate on Constitutional matters..

IMHO, it would be a huge political mistake for any Presidential candidate to actually “Name” who they would nominate.

That potential nominee will become a secondary target for attacks by the media and others.

As I posted before. It will become an election, by proxy.

Cruz recommended Roberts for the Bush legal team that later fought Bush vs. Gore. But continue with your half-truths since many here don’t know the whole story.

Occam’s Razor applies. Roberts has been blackmailed once seated on the court. Note that the dissent in the Obamacare decision was originally written by Roberts as the majority opinion to overturn the law.

Never has a Supreme Court Justice flipped so quickly to then write a majority opinion upholding the same law. To have written both the majority opinion and the dissent in the same case is patently absurd.

This also means that Cruz’s assessment of Roberts for the court should not have reasonably foreseen a situation where a future President would blackmail the Chief Justice into subverting the rule of law.

Even Reagan who selected a wonderful justice, like Scalia, made a mistake and also selected “swing voter” Sandra Day O’Connell.

So what kind of judges would pro-ILLEGAL eminent domain Trump pick?

In my book of FICTION..my novel would go like this:

A candidate born on foreign soil offed the SCOTUS judge when it was rumored he was going to rule against candidate..with the help of the former intelligence officers who knew about the HEART ATTACK GUN...who just happened to work for the Campaign Manager in the company he founded.

Not that I think Cruz or anyone associated with Cruz would do such a thing..but it makes a fun novel with all kinds of twists and turns.

Of course, a more realistic and plausible suspect would be ..ahem...the current POTUS who wanted to nominate a Judge who would rule in favor of a case that was coming before SCOTUS during the summer.
