I disagree also. No papers....out you go.
As an Administrative Law professor once said: “Sure, everyone is entitled to due process. The question is what process is due.”
Actually, I feel the same. I realize the Declaration and Constitution says “all men are......”
But my interpretation of it is for US citizens or persons legally here. Might not be right, but it’s the way I feel.
NO! It is not an “open question”. They are not US citizens under any scenario and they are here illegally. They get the boot! No if, ands, or buts.
Someone should ask Bill if that includes guns.
Nah, sue them all for the fun of it.
When the Establishment says it “settled” what they mean is their emotion based PC dogmas trump their abilty to think about the issue.
Climate change? “Settled Science”
Abortion? “Settled Law”
Anything about Illegal Immigration? “Settled Law”
Trump is the kid pointing out to the PC Empire in Politics/Media that no, in fact, they are not wearing any clothing.
Then speed up the process...no reason to drag it out like they do. Should be a one day deal.
Due to our Guantanamo guests, that question was hanging over most of the court cases dealing with the detainees. That is why the whole thing went to military courts, since they are military prisoners.
But the final determination was made that they do NOT have due process, because they are not citizens. The Law of Land Warfare assisted in this determination, because it specifically stated that prisoners could be held until the war was over and that they did not come under capturing countries laws unless they specifically broke those laws during the period they were held.
As applicable, which would certainly mean a fair trial on both civil and criminal aspects of allegations that they are present illegally. Civil is easier, so they could be shipped out on less than it would take to charge with a crime.
Trump can disagree all he wants but if the law requires an administrative process be followed in order to deport someone then the law has to be followed. Trump can work to change it but he can’t ignore it. We’ve had too much of that from occupants of the Oval Office already.
They are invaders. Not burglars. Not tresspassers even.
I believe Trump is right, if they are foreign subjects then we should NOT be obligated to waste legal resources on them, back they go. Promptly and with due respect, not all are bad people.
Deport illegals!
Expel muslims!
Due process means a simple hearing to answer one question: Are you here illegally? Deport. Where you born here as a result of your parents being here illegally? Your a citizen of their country of origin born abroad. Deport. You can’t be a citizen automatically as that rewards your parents committing a crime against the U.S and it’s lawful citizens. You had a child with an illegal and want to keep the family together? You can move back to his country then since you like exotic cultures so much.Your anchor baby seeking boyfriend/husband is illegal.Deport.Enforce one simple standard, Are you here by permission of the United States? Yes, welcome to America! No,deport. Easy law, easy fix. This is true comprehensive immigration reform as it encompass all illegals here wait for it......ILLEGALLY!
Sorry, Trump is wrong on this.
In the case of an illegal alien, due process consists of determining that. Once determined, and assuming that an illegal alien had no further “rights” (which he doesn’t) then it is out you go.
Consider - how many articles do you carry on your person at any given time which can be used to unequivocally prove that you are a citizen? Without due process, you are not allowed to get anything else, you may not testify, and no one can testify for you.
IOW, without due process, anyone can be jailed and deported simply because they are not carrying proof of citizenship.
PING
They should change the name of the show. Donald Trump have to be on the show almost as much is Bill O’Reilly.
As usual, O’Reilly blusters through a complex issue making a muddle of it. IMHO, Trump was actually closer to the truth in the context of their conversation. There is no question that illegal aliens enjoy constitutional rights and are entitled to due process to protect them. For example, you cannot, legally, just beat them up and take their wallet. O’Reilly was right about that, but that’s not what they were talking about. No illegal alien has a constitutional right to enter the US, or even stay here. Such due process as they are entitled to in that area is only what law congress provides them by statute, and, frankly, it’s constitutionally obliged to provide very little if anything. That’s what Trump meant and he was right.
Unless Congress changes that, they get a hearing.
