NO! It is not an “open question”. They are not US citizens under any scenario and they are here illegally. They get the boot! No if, ands, or buts.

The question would be is if there is something in our immigration law that determines any of these 'illegals' have the ability to claim asylum.

If so, then there would be some form of due process.
