Justice Department rules Hillary Clinton followed law in deleting emails

The Obama administration told a federal court Wednesday that former Secretary of State Hillary Rodham Clinton was within her legal rights to use of her own email account, to take the messages with her when she left office and to be the one deciding which of those messages are government records that should be returned.

In the most complete legal defense of Mrs. Clinton, Justice Department lawyers insisted they not only have no obligation, but no power, to go back and demand the former top diplomat turn over any documents she hasn’t already given — and neither, they said, can the court order that.

The defense came as part of a legal filing telling a judge why the administration shouldn’t be required to order Mrs. Clinton and her top aides to preserve all of their emails.

Uhhhh....the same Goudy whom has been ‘surprised’ by the discovery of e-mails/documents and unlawfulness using FOIA requests?

I wouldn’t put him in charge of the People’s Court, let alone anywhere near the DoJ

18 U.S. Code § 793 - Gathering, transmitting or losing defense information

(f) Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer—

Shall be fined under this title or imprisoned not more than ten years, or both.

Hillary knows where the bodies are buried.

She won’t be the nominee but he’s not going to let her go down for such a national security matter. She’d have to spill the beans about Benghazi and the 2012 election scam.

Wow. Just wow.

Do we need any more proof of blatant criminal collusion in our Federal government? I really didn’t see such a sweeping declaration of innocence coming I thought at least the Justice Dept would tack on a few nonsense indictments that would go no where and eventually be dismissed in a few weeks but this?!

It’s like the criminals don’t care anymore who sees them do what they do! This is literally like as if a jewel thief walked into a jewelry shop, smashed the glass took all the jewels and walked causally out, while the security guard held the door open for him!

It’s over folks, if they feel they can be this brazen. Game over.

Now that fake “apology” a few days ago on ABC makes even MORE sense! Tie up all the loose ends. She probably knew then she was in the clear, timing it all to be nice and neatly burried in the next news cycle and weekend coming up.

Now it’s just as I and others on FR predicted: any more questions in the future about this scandal, much less Benghazi (this scandal was actually a product of that investigation remember) will be easily rebuffed by a simple “oh that old news? We dealt with that back last summer. Weren’t you paying attention?”

Now Cankles can start to unleash the Clinton war machine on Bernie, and reclaim the coronation she richly deserves.

Sick. Absolutely sick. If I didn’t have faith there is indeed a God almighty that she will have to answer to someday I’m pretty sure I’d kill myself. What point would there be to put up with this level of s*** day in and day out?

My goodness, talk about the very DEFINITION of “INjustice”!

But course it’s a stupid law. It doesn’t allow for the death penalty.

DGARA what State Department policy says. Policy can only be more strict than statute. In this situation it is less strict that the law.

Bad headline. The DOJ argued this position. They didn’t rule on it, Only the judge can do that.

One might question whether their brief was very political or in the public interest. I’ll be interested to read it to see how they argue to get around the laws of the land which have been enforced by the DOJ in other similar, but less clear, cases so forcefully.

Obama hates the Clintons, but he wants a Democrat to win in 2016. He may have decided none of the other potential candidates can win a two-person contest. If it looks like Trump is going to create a third party (that is, if he doesn't get the Republican nomination) then the Democrat could win with 40%, so then Obama could let Bernie or Biden become the nominee and throw the book at Hillary.

But he may also be mindful of the trail of dead bodies the Clintons have left behind themselves.
