Mark Levin has done a whole show today on birthright citizenship. This would be the 8/18/2015 show. He made it very clear that birthright citizenship is not in the constitution or protected under the constitution for foreigners. He went into the history of who has the right to citizenship as defined in the jurisdiction clause of the 14th amendment . He also goes into the fact that congress has the right to define who gets citizenship under article 1,section 8. This discussion is very very specific and shows that this mess is a failure of congress to act and nothing more.

It is an outstanding briefing if you are all confused.

I also found this very very timely in light of Trump's immigration proposal. When Trump says he wants to repeal birthright citizenship he means he can do it through congress and does not have to go through the courts. This show was an amazing eye opener. Levin sure seems to be confirming what Trump wants to do.

I’m not arguing that he’s wrong in his conclusion, but if there is a conflict between Article I, section 8 and the 14th Amendment, the latter would negate the former in that case. That’s how amendments work.

Levin's point that an illegal is not under the jurisdiction of our government is totally valid. If the illegal gave himself over to US jurisdiction he would be detained and deported back to the country that does have valid jurisdiction. The illegal intentionally rejects US jurisdiction.

Words mean something.

The amendment does not state: "All persons born or naturalized in the United States are citizens of the United States and of the State wherein they reside."

It instead states:"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

Even a SCJ should have been able to understand the meaning.

Citizenship and Immigration MUST BE SCRAPPED..
Re-imagined.. Re- worked.. Re-tooled....

and the concept of “INSURGENTS” approached..
Testing of ALL legal immigrants and illegagrants..
and graded for possible inclusion..

right after the WALL (is started) to be built..

When this is started many will deport themselves..
Not wanting to rid themselves of Mexican citizenship..
Being proud of the latrine they call Mexico..

Levin's point is wrong, because the relevant person for 14th Amendment purposes is not the illegal alien him/herself, but rather the U.S.-born child. Levin may be correct that the illegal intentionally rejects U.S. jurisdiction, but the question of whether the child is subject to U.S. jurisdiction is far less clear.

Over the years there have been many FReepers that claim they have provided proof the 14th does indeed provide citizenship for illegals dropped on U.S. soil. Many of us who've claimed it doesn't have been called names like xenophobe, racist, etc.

It's a damned shame we lost many on FR who spoke out vehemently against this invasion (even Rush finally called it that today - about ten years too late) and were banned or got too fed up with the abuse.

BTW, this invasion was small change till Bush got in. He really got it going and his brother wants a chance to get in on the destruction. I now hate the Bushes for what they've done to this country's sovereignty.
