CINCINNATI - UC police officer Ray Tensing's body camera video clearly shows that he committed "murder" when he shot and killed an unarmed black motorist at a traffic stop, prosecutor Joe Deters said Wednesday.
The shocking video shows Tensing, standing outside the driver's door, with 43-year-old Sam DuBose at the wheel, talking peacefully for about 90 seconds. Tensing repeatedy asks DuBose to produce a driver's license. DuBose says he has a license but he doesn't have it with him.

No, if someone tries to run you over and you defend yourself, that is not murder, that is self defense.
I can’t clearly see that the man tried to run him over though.
I don’t know if he fell down after he shot him.
What i am saying is that after watching the video, it looks like he murdered him.
But maybe he didn’t. I am willing to hear all evidence fairly.
Here’s another possibility. Maybe when he pointed his gun at the man, the moving car hit his hand and caused the gun to fire. The discharging of the weapon seemed... strange or something.
And no, no CVSs need to burn at all. This is what we have court for.
The only thing that matters is the truth, so let’s effort to discover what it is.
In some senses the ‘Good’ cops who have refused to rat out the ‘bad’ cops have brought this on us all.
Plenty of police who have been aware of the behavior of a few thugs and psychos but never said or did anything to get them off the force, even though these same cops never did anything wrong themselves are now upset that they are tarred with the same slime. I mean can anyone say that when an officer with 5 or 10 years on the job abuses a citizen that most of their co workers are actually surprised? I don’t buy that. A person is guilty of whatever behavior they tolerate.
One bad apple plays RIGHT into the hands of the Sharptons and Jacksons, but how many of the other 99 knew this guy liked to power trip civilians..... Just look at the actions of ANY police union in the wake of even the most egregious abuse of police power.
I cant say for sure if the man had a weapon or not...

He had a weapon. A two-ton weapon on four wheels. Courts have routinely sided with the cops who argue the suspect was using his vehicle as a deadly weapon as he tried to run over the cop as he fled.
Cops are actually taught how to move their way into the path of the fleeing vehicle but not get hit. The are told that their hand on the door of a car as it pulls away constitutes deadly assault that justifies deadly force.
In Cop-land, this was a clean shoot.
He reached for the bottle after the officer asked, "What's that bottle on the floor, there?" Hardly a furtive movement.

I don't think this is a murder rap, technically, but the prosecutor can "work it down" at the point of jury instructions - or leave it at murder, in which case the jury is apt to acquit.
Looks like an unfortunate but lawful shooting to me.

Why? That’s when the decision was released by the Supreme Court. Nothing since has over-turned that decision.
He was knocked down after he shot him, and he was knocked down because the car sped off after he fired the shot (y'know, because DuBose's dead body slumped forward, causing the car to accelerate). The guy didn't try to run him over - the car sped off after he was dead.
I observed several mistakes from this officer.
1) when making a stop and approaching the car, place hand on the car where it can be recorded. This “finger prints” the car with the officers finger prints and allows for later verification that was the car should the stop go bad.
2) When the driver failed to produce a drivers license, should have given the order to step out of the car and request backup.
3) Should have pushed the driver for a name and address. After receiving the name and address, gone back to the patrol car, ran the name and requested backup.
4) When the bottle was produced, should have ordered the driver to step out of the vehicle
There are others but those are the big ones.
But - since DuBose is (was) black - then its now a racist issue.
You're right that cops have shot and fired in these situations, and gotten away with it. But the reason this cop isn't getting away with it isn't because DuBose is black - it's because the cop was wearing a body camera. A body camera that shows, very clearly, that DuBose was not trying to run the officer over, and in fact posed no threat to the officer's life (or the life of anyone else).
Thinking the discharge may have been unintentional, the result of a finger rightfully placed on the trigger of a weapon as another weapon, the car was about to speed off.
Car strikes arm, hand, weapon ..finger tugs trigger and we get a bang and a bullet in a skull. At least that’s what I can see. I don’t think this stop was about killing a guy who was drinking and driving in an improperly tagged vehicle.

Seriously, who cares? Even if Tensing wasn’t knocked down, the assault occurred when DuBose put the car in gear.
It was difficult to see if he was reaching for something. But the cop apparently felt threatened and what were they grappling over? The man was acting evasive too.
I would have shot him after I asked for his license twice but that’s just me.
Does anyone know what happened to the Gin. That there is alcohol abuse.
DuBose's act of putting the car in gear did not justify the use of deadly force.

The suspect started the problem by resisting by refusing to unbuckle, closing the door the cop had just opened, starting the car and putting it in gear.
At the point, the officer reached in to get the keys. The suspect grabbed him. Struggle ensues then the huge point occurs:
The suspect leans away, reaching for something by or under the other seat.
The car begins forward and bang.
The suspect grabbed the officer and reached for something.
Repeat.
The suspect grabbed the officer and reached.
Could the officer at the point tried to duck and roll? Sure, if the guy didn’t have his arm, probably his first choice. But he’s hanging inside the window, guy has a hold of his arm, starting to move the car, and going for a weapon.
Guarantee that’s what was foremost on the officer’s mind.
The issue these days is whether or not the officer put himself in the dangerous situation that led use of deadly force. In other words...I can’t walk and stand in front of a moving car, and then say I feared for my life and shoot the driver...
We have been training for years now to avoid “ creating our own need for deadly force”
