Ted Cruz: States should ignore gay-marriage ruling
Politico ^ | 06/29/2015 | By ADAM B. LERNER

Ted Cruz has some unsolicited advice for the states not specifically named in last week’s Supreme Court ruling on gay marriage: Ignore it.

“Those who are not parties to the suit are not bound by it,” the Texas Republican told NPR News’ Steve Inskeep in an interview published on Monday. Since only suits against the states of Ohio, Tennessee, Michigan and Kentucky were specifically considered in the Supreme Court’s Obergefell v. Hodges decision, which was handed down last Friday, Cruz — a former Supreme Court clerk — believes that other states with gay marriage bans need not comply, absent a judicial order.

“[O]n a great many issues, others have largely acquiesced, even if they were not parties to the case,” the 2016 presidential contender added, “but there’s no legal obligation to acquiesce to anything other than a court judgement.”

While Cruz’s statement may be technically true, federal district and circuit courts are obligated to follow the Supreme Court’s precedent and overrule all other states’ same-sex marriage bans as unconstitutional.

The Texas senator then went on to suggest that Republicans who have called for following the court’s decision are members of a “Washington cartel” and are lying when they say they do not support same-sex marriage.

“[Republican Party leaders] agree with the rulings from last week, both the Obamacare ruling and the marriage ruling,” Cruz said. “[T]he biggest divide we have politically is not between Republicans and Democrats. It’s between career politicians in both parties and the American people.”

Good idea but it’s too late and the officials are all afraid of being fined or litigated. sigh

Law clerks for Supreme Court justices have a lot of prestige, and frequently have distinguished careers. Justices Roberts and Kagan are former clerks.

I know, but to the dunders who believe the sun rises and sets on Obama and Politico, they want people to think that Ted Cruz is truly lacking because he was only a “clerk.”

Here in Tennessee the Constitutional rights of the people of the state have been trampled on...and then some...

In 2006 we voted to add an Amendment to our state Constitutional...the Marriage Protection Act...

making marriage one man one woman..(biologically born that way, that is)

the vote was 81% for 19% against..

Bet this is a stake through the heart of his chance for the oval office though.

I’m not sure there’s any higher honor except serving on the SC itself. A Politicon might not understand that, it’s true.

I wonder what the left would think if a Republican president were to do this to the White House.

Are you saying the quotes they attribute to him are a lie?

“Why ???”

He’ll sweep the already red states. This position will keep him from picking up a single swing state.
Except I don’t think he’ll get out of the primary so it probably won’t matter.
I think being vocally against gay marriage is going to have about the same result that being an anti-war candidate was in 2004.

That didn’t help either.

...

And that’s why I’ll vote for Ted Cruz. He gets it and tells it like it is.

The states should decide..

Its up to the people in each individual state whether they want same sex marriage or not..

and why would 2 homosexuals living in MASS be concerned about what the people in Tennessee think of their “legal” arrangements ???

Each state has different laws for driving...speed etc..

While it was 70 on our highways in TN, 24/7, I would go up I-81 to find that VA had signs that read 65 at night while it was 70 during the day..just be crossing the state line..

well I should have felt I could still go 70 at night in VA since I could in TN..etc

I just know that should be a SCOTUS case...

and there’s no immorality involved either...

etc

Don’t expect states to practice nullification if you won’t practice it yourself.
