Scott Walker calls for Constitutional amendment to let states define marriage

Wisconsin Gov. Scott Walker, seizing the moment after the Supreme Court’s landmark ruling legalizing same-sex marriage, called Friday for a Constitutional amendment that would allow the states to decide whether gay marriage should be legal.

Walker’s call came shortly after the high court ruled 5-4 that same-sex couples could marry across the country, overturning a number of state same-sex marriage bans.

The ruling was “a grave mistake,” the Republican governor said, touting his support for amending his state’s constitution “to protect the institution of marriage from exactly this type of judicial activism.”

“As a result of this decision, the only alternative left for the American people is to support an amendment to the U.S. Constitution to reaffirm the ability of the states to continue to define marriage,” Walker said in the statement.

Walker’s statement put him directly at odds with one potential 2016 rival, South Carolina Sen. Lindsey Graham, who said he didn’t support pursuing a constitutional amendment.

“[G]iven the quickly changing tide of public opinion on this issue, I do not believe that any attempt to amend the U.S. Constitution could possibly gain the support of three-fourths of the states or a supermajority in the U.S. Congress,” Graham said in his statement. “Rather than pursuing a divisive effort that would be doomed to fail, I am committing myself to ensuring the protection of religious liberties of all Americans.”

Such an amendment would face steep odds on Capitol Hill.

Correction: The original version of this story said, wrongly, that Walker was calling for a Constitutional amendment “defining marriage as being between one man and one woman.”

Walker is calling for a tactic that he knows is doomed from the start but knows it’ll help him in the primary. See the replies I get from this post as proof. “At least it’s something.”

The Supremes would hold that Amendment unconstitutional.

Who will just stare them down and do the opposite of what they say?

Texas should refuse. Let the Supremes bring their army.

Its a symbolic political ploy like the Human Life Amendment after Roe vs. Wade weighed in on abortion in 1973.

FAKE, PHONY, PLASTIC AND A CHARADE IN THE FACE OF TYRANNY COMING DOWN AGAINST THOSE WHO HAVE CONSERVATIVE RELIGIOUS BELIEFS ON SEXUALITY AND MARRIAGE IN THIS NATION.

4) States who will just ignore the ruling since there is no constitutional authority anyway.
5) Their delegation in DC do everything they can to support their state’s nullification of tyrannical government.

Exactly right. And he just gave his political enemies plenty of fodder to use against him. Fodder that 67% of the country supports. He acted poorly today. Gay marriage - and that’s what it is - is here to stay.

The court would just rule it all unconstitutional in one nonsensical brain-fart. Yes the would. More laws can’t reign in the lawless. Article V should be completely ruled out as a solution at this point. The states no longer have a contract with the federal government and can protect inalienable rights without needing permission from the feds. The federal government is a criminal enterprise and can’t be dealt with. If you’re going to implement some mechanisms that bypass the feds, why wait until you get 33 states to go along with you? Just do it. You’re no longer bound by the constitution because it’s been shredded.

It was a good idea, but it should have been done 30 years ago. It’s too late now. Only massive disobedience can insure our freedom now.

Nice idea.....lip service.....will never get ratified....

I'm not the biggest Scott Walker fan, I prefer Ted Cruz, by a lot, that being said, I call B.S. on that post of yours.

This was the correct response and the correct goal, whether or not YOU think it will get ratified.

I'd bet if someone had said something similar about slavery in 1776, many would have stated the same pessimistic reply.

“Wisconsin Gov. Scott Walker (R) is calling for a Constitutional amendment to allow states to define marriage and strip the Supreme Court of its authority over the issue after the justices legalized same-sex marriage nationwide.

Won't work. Against State Reciprocity. Impeaching Justices is the proper course.

It’s really hard for enough people to understand what’s happening. Cruz is saying, “This is lawlessness. When I’m president I’m going to repeal Obamacare.” Hah! He’s going to make a law to fix lawlessness? We really need some pols who’ll stop nasal gazing and put all this together.

It’s actually the kind of banal response I’d expect from him. He knows it’ll never happen but the message boards and Facebook will light up with his comment. It might get him a few primary votes. That’s all.
