A North Carolina officer shot dead a 74-year-old man whose concerned family had called the police and asked to check on him.
Officer Josh Lefevers arrived at the home of James Allen just before midnight on Sunday morning and announced he was entering the residence when Allen approached him with a handgun and refused to put it down, police said.
Lefevers then shot and killed him.

Please explain the right tool then.
Police across this nation are sent out on missions like this every single hour.
Only call em to come pick up the dead perps.
.
Your vision is not quite 20-20.
The officer failed to acquire consent to enter; he was an unlawful intruder.
Murder one, open and shut!
.
So then a guy who lives alone in his house and who dies will forever be left in his house, because nobody could ever enter it.
Got it.
.
>> “Maybe he did knock on the door, but received no answer?” <<
.
Oh, did he call out the man’s name?
Murder one!
.
The investigation found the officer was following department procedure.
Thanks,and sorry for your loss.
I’m an 82 year old woman myself and it isn’t easy.
.
That is your job. If you are not close enough, make the arrangements with others in advance.
.
Cold blooded murder is “department procedure?
.
“————————presumably entertaining fellow officers with the story of how he shot this old man to death in his own home because the old boy couldnt seem to follow instructions”
You’re sick.

The police are not mental health counselors, marriage counselors, rehab counselors, family coaches, anger management mediators, bed-checkers, dietary managers, or clergy in a pinch.
If you have a loved one with any of the above conditions, please make alternative arrangements for their wellness beyond calling the po-po.
Your loved ones and family are your responsibility, not a 911 dispatcher’s and certainly not anyone carrying a gun!
Certainly if the next of kin is near by then they should be the first on the scene to enter the house and even break in if they have to.
Perhaps the next of kin wan't near by.
So they called the cops who then called the fire department and EMS.
Perfectly reasonable.
That he didn't feel like answering the phone? At my house, it's my phone and I pay the bill; if I don't feel like answering it, I don't have to.
Folks, there's only one logical conclusion to draw... unless there's no alternative, whatever you do, DON'T CALL THE POLICE!
According to you, he would never be found, because nobody is allowed to enter the house.

OH!

If you asked the police to check on your father, because he was elderly and may be in medical duress, would you consider it a reasonable response for the police to knock on the door and walk away, after having received no answer because they didn’t want to violate his Constitutional rights? What if your father was on the floor and out of sight?
You’ve already established that your father has a condition that puts him at an elevated medical risk. That to me has established the required scream that would allow the police officer to enter the home without a warrant.
Does not end up with a killed homeowner who committed no crime, and a policeman who will now be carrying this around with him for life. The police are not social workers. The "missions" you refer to are supposed to be enforcing laws and responding to crimes, not breaking into people's homes and doing bed checks.
Makes sense to me...Apparently the cop went in with his gun drawn...
With individual liberty comes a great responsibility. We do not have an ala carte constitution where we pick and choose which rights we want to apply and when. They either exist or do not.
