FERGUSON, Missouri A federal judge ruled Thursday that police can no longer use tear gas on protesters without declaring an illegal assembly, giving them fair warning and time to vacate the area.

The cops should tell this federal judge to f*** himself. He cannot declare procedure for police to use. That isn’t his jurisdiction. He is not the executive.

Legal niceties are important and must be observed. There is nothing that I see here that isn’t just good police procedure and should have been used all along.
It is, or was and still should be, a cardinal rule that when deploying riot control agents, you give the mob a warning and a place to disperse to. You really shouldn’t drop it unannounced. You cannot pen them up and use tear gas on them. Blind animal panic will take over and people will get hurt or killed, and some of them might be your control force.
Pepper spray in a one-on-one encounter is different. You use that with little warning so that your opponent doesn’t have time to shield himself and you can get the full dose into his orifices.
