Washington (CNN) -- The New York officer involved in the death of Eric Garner should no longer be on the police force, Sen. Rand Paul argued Monday.
The Kentucky Republican said Daniel Pantaleo lacked "discretion" when he placed Garner in a chokehold for allegedly selling untaxed cigarettes.

There was a black female sergeant at the scene supervising the arrest. At no time did she try to de-escalate the situation or call off the officer. The grand jury also believes that no crime was committed.
Didn't die for selling cigerettes; died for resisting arrest. If ya' can't do the time; don't do the crime.
Garner had a stress induced heart attack. If he hadn’t died then, he’d be dead by now anyway.
“The officers involved were doing what they were told”
So were the Nazi officers. :-)
Misspelled, Randi.
Funny thing. The day the grand jury decided not to indict, I saw an episode of COPS where an officer used a very similar move on a suspect. There was only the one officer though. The officer was a big guy, looked like about 240lb’ish. He had his arm wrapped around the suspect’s neck and he lay flat on top of him until his backup arrived.
What little momentum he had going ended when Rick Santorum in 2012 came to the immediate defense of the popular Trayvon Martin, not even knowing what had happened.
It was not a “chokehold death.”
It was a resisting-arrest death of a man in very poor health.

Plus the on-scene supervisor, who could have halted the arrest at any time, was given full immunity.
The supervisor also happens to be a black female.
If you are going to hold anyone responsible for Eric Garner’s death, shouldn’t it be the person actually responsible?
Get up off your knees and get some facts Mr. Paul, watching a brief cellphone video and making your pronouncement is not the way a leader acts. There were 58 witnesses who testified over 6 weeks, but you KNOW what happened by watching a cellphone video?
Its not a chokehold death. The coroner said the “chokehold” didn’t cause garner’s death. That’s why the grand jury wouldn’t indict.
I would say the cop should be fired, except the government of new york did not ban chokeholds, so it may not have even been a case of misconduct.
And BTW rand paul is a rino amnesty loving turd. Screw him.
“His left arm didnt get around Garners neck until after Garner almost put him through a large window.”
As an EMS professional ( ER physician and former EMS medical director) I was shocked at the slow and incomplete response the EMT’s took in the case. In the second video which shows the EMS response, Garner looks like he’s unresponsive and probably not breathing for 3 or 4 minutes after the EMT’s arrive and they aren’t doing any of the things I would expect them to be doing ( listening for breath sounds, checking a pulse ox, putting the pads on to check his cardiac rythym, putting him on oxygen etc. If they had reacted more quickly the guy might have survived.
I suspect he suffered either a primary Myocardial Infarction, or a respiratory arrest, followed by MI. Just putting a guy that big down prone can cause his O2 sats to drop like a rock.
How about the black female sergeant that supervised the arrest? What is Ron Paul, Junior’s take on her?

Sharpton looks like a cancer patient in that photo.
” And BTW rand paul is a rino amnesty loving turd.”
This alone condemns him.
Why is this a federal issue?
Not a choke hold, but a headlock.
Rand should change his name to Pander.
Pander Paul.
Has a certain ring to it and fits his character.
