Boehner: House GOP files Obamacare suit

House Speaker John Boehner said Friday he has sued the Obama Administration in federal court over its decisions to make changes to the President's health care law, which congressional Republicans argue were unconstitutional.

The move was expected for months -- the GOP-controlled House of Representatives voted to approve the lawsuit in July. But Boehner had trouble retaining a law firm that would take the case because of the political furor over the controversial health care law.

"Time after time, the President has chosen to ignore the will of the American people and re-write federal law on his own without a vote of Congress. That's not the way our system of government was designed to work," Boehner said in statement on Friday.

He added, "if this President can get away with making his own laws, future presidents will have the ability to as well. The House has an obligation to stand up for the Constitution, and that is exactly why we are pursuing this course of action."

I'm in this camp, actually. I'd rather that the House make use of the truly useful tools that they have in hand, but I think this lawsuit is well-timed with last night's lawless action by the preezy. A majority of people don't like the ACA, and they don't like Obama's approach to illegal immigrants, either, so I don't see this being a loser for the GOP. Still, they will have to do more since Obama and his minions won't give a fig about this lawsuit.

What happens if Boner loses his lawsuit? Then what? What is the supreme court rules against Boner and sets a precedent in favor of 0bama? Boner plays checkers while the other guy plays chess.

People on FR who have no experience or teaching on the subject are calling for things that will distract the Congress in the next 18 months from governing and getting the critical things done before 2016 election.

Impeachment proceedings with Clinton was drawn out, expensive, and served no real purpose.....what did we get out of the whole scenario?

You are crazy. You can get the congress to impeach the president which then puts it over to the senate to give him the boot. Even though it can be a simple majority in the congress to impeach the president, it will take 2/3rds of the senate to give him the boot. To go through the process of impeachment just because you want to is crazy. Have you forgotten what happened with Clinton?

No they sank the Lusitania which brought us into WW1 and the USS Maine that is what caused the Spanish American War. When the British sank the Bismarck that caused America to get into the war too. The Americans were ticked that British sank the Bismarck.

I know you were being sarcastic so am I being about the Bismarck too.

Clinton was successfully impeached. That is what we need to do for obama. Did he commit high crimes or didn’t he? If the answer is yes than he should be impeached not just once but each time he commits a high crimes. Yes - multiple impeachment. History should show that he was impeached and why. To hell with the RINOS and bed-wetters. They can kiss my ass.

Actually, yes. The only thing I've seen in print with any hope of actually happening is a plan to "censure" him.

Personally, I think they should hold their breath until they turn blue. That'll show they're really mad.

My personal preference is for all the top Republican leaders to go on a hunger strike until our dictator caves. He won't, of course, but the country would still be better off.

That is a waste of time and taxpayers dollars and, as in the case of Clinton, it made him more popular. You impeach with only one mission, to get it over to the senate where they will give him the boot. As it stands right now, there is no way the senate will go for it.

I think you need to think things through better. Just saying ...

Perhaps Boehner’s strategy is to use a second tier law firm to lose the case. Then he can shed a tear on camera and tell the GOP, “we tried”. Then on to dinner at the Capitol Grille with the K street boys.

I emailed Prof Rob Natelson, renowned Constitutional scholar, and a surprisingly responsive person. Also a conservative constitutionalist, he replied:

It is the job of the President, not Congress, to "take Care that the Laws be faithfully executed." Congress can enforce that, to a certain extent, through tailored use of its funding authority, through lawsuits, and through impeachment. Rob

So, Boehner's action is one of the 3 courses of action Prof. Natelson says are available.

It’s a slippery slope of precedent. Say we have a conservative POTUS in 2016. No anti-abortion bills get through congress. He/she can order a ban on abortion. Where will it stop?

If he’s not challenged now, this could be the beginning of the end of the republic.

Their staffs report on what the people are calling about.

They are not back in DC until Dec.11th.
